Governor McAuliffe Signs Executive Order Protecting Virginia’s Coastal Resources

Today Governor Terry McAuliffe signed an Executive Order continuing the Virginia Coastal Zone Management Program, a network of Virginia state agencies and local governments designed to protect the natural and economic assets located within Virginia’s coastal regions.

“From protecting the wildlife and fisheries of the Chesapeake Bay to meeting the threat of sea level rise, Virginia has a responsibility to protect our coastal areas and the vital natural and economic resources they offer,” said Governor McAuliffe. “The Coastal Zone Management Program is a critical framework for our Commonwealth’s stewardship of these important assets, and I intend to give it the full support of my administration.”

U.S. Representative Robert Wittman continued, “For over 25 years Virginia’s Coastal Zone Management Program has helped coordinate the Commonwealth’s efforts to protect  and restore coastal communities and natural resources. Virginia’s Chesapeake Bay, wetlands, and beaches are national treasures; these efforts to enhance coastal communities and ecosystems benefit us all.”

NUMBER THIRTY FIVE (2014)

CONTINUATION OF THE VIRGINIA
COASTAL ZONE MANAGEMENT PROGRAM

Importance of the Initiative
           
            The Virginia Coastal Zone Management Program's (“Program”) mission is to create more vital and sustainable coastal communities and ecosystems. The Department of Environmental Quality will serve as the lead agency for this networked program and will be responsible for allocation and assignment of all federal funds received for the Virginia Coastal Zone Management Program Implementation Grant.

            By virtue of the authority vested in me as Governor under Article V of the Constitution of Virginia and under the laws of the Commonwealth, including but not limited to Sections 2.2-103 and 2.2-104 of the Code of Virginia, and subject to my continuing and ultimate authority and responsibility to act in such matters, I hereby continue the Virginia Coastal Zone Management Program.

POLICY GOALS

            State agencies having responsibility for the Commonwealth's coastal resources shall promote the Coastal Zone Management Program consistent with the following goals:

Coastal and Ocean Resource Protection

            Goal 1: To protect and restore coastal and ocean resources, habitats, and species of the Commonwealth. These include, but are not limited to, wetlands, subaqueous lands and vegetation, beaches, sand dune systems, barrier islands, underwater or maritime cultural resources, riparian forested buffers, and endangered or threatened species.

            Goal 2: To restore and maintain the quality of all coastal and ocean waters for human and ecosystem health through protection from adverse effects of excess nutrients, toxics, pathogens, and sedimentation.

            Goal 3: To protect air quality.

            Goal 4: To reduce or prevent losses of coastal habitat, life, and property caused by shoreline erosion, storms, relative sea level rise, and other coastal hazards in a manner that balances environmental and economic considerations.

Coastal and Ocean Resource Sustainable Use

            Goal 5: To provide for sustainable wild fisheries and aquaculture.

            Goal 6: To promote sustainable ecotourism and to increase and improve public access to coastal waters and shorefront lands compatible with resource protection goals.

            Goal 7: To promote renewable energy production and provide for appropriate extraction of energy and mineral resources consistent with proper environmental practices.

Coastal and Ocean Management Coordination

            Goal 8: To ensure sustainable development on coastal lands and support access for water-dependent development through effective coordination of governmental planning processes.

            Goal 9: To avoid and minimize coastal and ocean resource use conflicts through research, planning, and a forum for coordination and facilitation among local, regional, state, and federal government agencies, interest groups, and citizens.

            Goal 10: To promote informed decision-making by maximizing the availability of up-to-date educational information, technical advice, and scientific data including the use of new tools such as marine spatial planning.

IMPLEMENTATION AND ENFORCEMENT

            The following agencies, in cooperation with local governments, as appropriate, shall have primary responsibility for implementing the enforceable policies of Virginia's Coastal Zone Management Program as approved by the National Oceanic and Atmospheric Administration:

            In addition, other agencies that conduct activities that may affect coastal resources shall conduct such activities in a manner consistent with and supportive of Virginia's Coastal Zone Management Program. For purposes of this Program, the Coastal Area shall mean Tidewater Virginia as defined in Section 28.2-100 of the Code of Virginia, inclusive of all tidal waters out to the three nautical mile Territorial Sea Boundary.

            The Director of the Department of Environmental Quality shall monitor all state actions that affect coastal resources. When, in the judgment of the DEQ Director, a state agency, regulatory board, or commission is about to act in a manner that appears to be inconsistent with the Program or has established a pattern of actions that appears to be inconsistent with the Program, the Director shall discuss the situation with the head of such agency, board, or commission to determine if a consistency problem exists.

            If, after discussion, the head of such agency, board, or commission and the Director of DEQ are in disagreement about the existence of a consistency problem, the Director will inform the Secretary of Natural Resources of the disagreement. The Secretary shall then determine if a state interagency consistency problem exists.

            If the head of such agency, board, or commission and the Director of DEQ agree that a consistency problem exists, they shall attempt to resolve the problem. If they cannot resolve the problem, the Director shall advise the Secretary that an unresolved interagency consistency problem exists.

            Upon notification of the existence of an unresolved consistency problem, the Secretary shall review the problem, determine how it should best be resolved, and affect such resolution within the Secretariat of Natural Resources or consult with other Cabinet Secretaries to resolve a consistency problem with agencies, boards, or commissions not within the Secretariat of Natural Resources. If unable to resolve the problem, the Secretary shall report to the Governor and recommend appropriate action. The Governor shall have the ultimate responsibility for resolving any interagency consistency problem that cannot be resolved by the Secretary of Natural Resources.

            Any person having authority to resolve consistency problems under the terms of this Executive Order shall resolve those problems in a manner that furthers the goals and objectives of the Program as set forth above and in accordance with existing state law, regulations, and administrative procedures.

Effective Date of the Executive Order

            This Executive Order rescinds Executive Order No. 18 (2010), issued by Governor Robert F. McDonnell. This Executive Order shall be effective upon its signing and shall remain in full force and effect until June 30, 2018, unless amended or rescinded by further executive order.

Governor McAuliffe celebrates signing of New Chesapeake Bay Watershed Agreement

Governor McAuliffe joined the Governors and other high officials from the Chesapeake Bay Watershed states, the District of Columbia and the federal governments in signing the 2014 Chesapeake Bay Watershed Agreement today in Annapolis, Maryland.

The Agreement, developed over the last two years, lays out clear goals and outcomes for sustainable fisheries, vital habitats, water quality, toxic contaminants, healthy watersheds, stewardship, land conservation, public access, environmental literacy, and resiliency of the Bay ecosystem in the face of changing climatic conditions and rising sea levels.

“We have made great progress in meeting our bay restoration goals over the last 30 years” said Governor McAuliffe, “however, there is always more to do and the pace of implementation must be accelerated.  This historic agreement lays out a path for improved science and policy, greater partnerships with citizens and stakeholders and allows for the flexibility necessary to make measurable improvements to a large and complex ecosystem.”

This is the 4th Chesapeake Bay Agreement signed since 1983, and the first to include full participation by the states of Delaware, New York and West Virginia who join the original signatories of Virginia, Maryland, Pennsylvania, the District of Columbia, the US Environmental Protection Agency and the Chesapeake Bay Commission.

State, University Leaders Welcome FAA Decision to Test Unmanned Aircraft

RICHMOND – State and university leaders in Virginia and New Jersey welcomed the Federal Aviation Administration’s approval today of their proposal to operate a test site to integrate unmanned aircraft into the national airspace.

With plans for the University of Maryland to join the partnership, efforts to introduce the safe and responsible use of unmanned aerial vehicles to the nation will be well-represented in the mid-Atlantic.

“We expect unmanned aircraft systems will be extremely useful for agriculture, utilities, search-and-rescue missions, disaster response and a number of applications that will generate jobs, industry and add millions of dollars in revenue to state economies,” said Virginia Governor Bob McDonnell.

In September, McDonnell, Gov. Chris Christie of New Jersey, and Gov. Martin O’Malley of Maryland expressed their commitment to jointly support test-site infrastructure in a letter to the Department of Transportation and the Federal Aviation Administration.

“Today's announcement brings the next frontier of aerospace research and development to New Jersey, and is an exciting opportunity for our state,” Governor Christie said.  “The cutting-edge research opportunities will create new jobs and spur STEM education, while building upon our deep roots in this arena. The entire state, and especially southern New Jersey, will benefit in the years to come from this important national award.”

The FAA has until 2015 to develop regulations aimed at limiting the privacy and safety concerns associated with unmanned aircraft. Congress called for the establishment of six national unmanned aircraft system research and testing sites through the FAA Modernization and Reform Act of 2012.

While much of the testing to date has been conducted under defense programs, continued work on the integration of unmanned aircraft into the national airspace will be implemented through a combination of federal, state and local government resources, along with academic institutions and private industry.

New Jersey and Virginia submitted a joint proposal led by Virginia Tech as the Mid-Atlantic Aviation Partnership, which unites academic, industry, state government and economic development organizations. The University of Maryland, College Park, was the lead agency in the Maryland application for an FAA test site, bringing together a similar consortium of groups and test ranges.

After submitting the applications, the three universities agreed to work as a united team to enhance the region's competitive position in the event that either or both proposals were selected by the FAA.

More recently, the Commonwealth of Virginia announced it will award $1.0 million during fiscal year 2014 in Federal Action Contingency Trust (FACT) funds to Virginia Tech to operate an unmanned aircraft systems test site. In the introduced budget, Governor McDonnell recommended an additional $1.6 million over the next two fiscal years for this project.

The funds will take the Mid-Atlantic Aviation Partnership from its current “volunteer” status to a fully functional and revenue-producing organization, capable of competitively analyzing and testing unmanned aircraft systems for industry and government.

“With our partners, we firmly believe we can introduce this new technology the right way,” said Jon Greene, interim director of the Mid-Atlantic Aviation Partnership and an associate director of Virginia Tech’s Institute for Critical Technologies and Applied Science. “Separately the team members have flown unmanned aircraft systems for thousands of hours, and now we have joined together to conduct unmanned aircraft systems research, development, and test and evaluation activities.”

In addition to expertise, the mid-Atlantic region contains both uncongested and restricted airspace, land and water terrain, and access to sea-level and high altitudes. The region also has an extensive agricultural base, which is considered the primary growth area for unmanned aircraft systems technology.

Integrating Unmanned Aircraft Systems into the national airspace could add more than $13.6 billion to the nation’s economy by the end of the decade, reaching as high as $82.1 billion by 2025, according to the Association for Unmanned Vehicle Systems International.

Anti Federalist Papers No. 26 – The Use Of Coercion By The New Government (Part 1)

The time is nearly at hand, when you are called upon to render up that glorious liberty you obtained, by resisting the tyranny and oppression of George the Third, King of England, and his ministers. The first Monday in April is the day appointed by our assembly, for you to meet and choose delegates in each county, to take into consideration the new Federal Government, and either adopt or refuse it. Let me entreat you, my fellows, to consider well what you are about. Read the said constitution, and consider it well before you act. I have done so, and can find that we are to receive but little good, and a great deal of evil. Aristocracy, or government in the hands of a very few nobles, or RICH MEN, is therein concealed in the most artful wrote plan that ever was formed to entrap a free people. The contrivers of it have so completely entrapped you, and laid their plans so sure and secretly, that they have only left you to do one of two things - that is either to receive or refuse it. And in order to bring you into their snare, you may daily read new pieces published in the newspapers, in favor of this new government; and should a writer dare to publish any piece against it, he is immediately abused and vilified.

Look round you and observe well the RICH MEN, who are to be your only rulers, lords and masters in future! Are they not all for it? Yes! Ought not this to put you on your guard? Does not riches beget power, and power, oppression and tyranny?

I am told that four of the richest men in Ann-Arundel County [Maryland], have offered themselves candidates to serve in the convention, who are all in favor of the new Federal Government. Let me beg of you to reflect a moment on the danger you run. If you choose these men, or others like them, they certainly will do everything in their power to adopt the new government. Should they succeed, your liberty is gone forever; and you will then be nothing better than a strong ass crouching down between two burdens. The new form of government gives Congress liberty at any time, by their laws, to alter the state laws, and the time, places and manner of holding elections for representatives. By this clause they may command, by their laws, the people of Maryland to go to Georgia, and the people of Georgia to go to Boston, to choose their representatives. Congress, or our future lords and masters, are to have power to lay and collect taxes, duties, imposts, and excises. Excise is a new thing in America, and few country farmers and planters know the meaning of it. But it is not so in Old England, where I have seen the effects of it, and felt the smart. It is there a duty, or tax, laid upon almost every necessary of life and convenience, and a great number of other articles. The excise on salt in the year 1762, to the best of my recollection, in England, was 4s. sterling per bushel, for all that was made use of in families; and the price of salt per bushel about 6s. sterling, and the excise 4s. 6d. on every gallon of rum made use of. If a private family make their own soap, candles, beer, cider, etc. , they pay an excise duty on them. And if they neglect calling in an excise officer at the time of making these things, they are liable to grievous fines and forfeitures, besides a long train of evils and inconveniences attending this detestable excise - to enumerate particularly would fill a volume. The excise officers have power to enter your houses at all times, by night or day, and if you refuse them entrance, they can, under pretense of searching for exciseable goods, that the duty has not been paid on, break open your doors, chests, trunks, desks, boxes, and rummage your houses from bottom to top. Nay, they often search the clothes, petticoats and pockets of ladies or gentlemen (particularly when they are coming from on board an East-India ship), and if they find any the least article that you cannot prove the duty to be paid on, seize it and carry it away with them; who are the very scum and refuse of mankind, who value not their oaths, and will break them for a shilling. This is their true character in England, and I speak from experience, for I have had the opportunity of putting their virtue to the test, and saw two of them break their oath for one guinea, and a third for one shilling's worth of punch. What do you think of a law to let loose such a set of vile officers among you! Do you expect the Congress excise-officers will be any better - if God, in his anger, should think it proper to punish us for our ignorance, and sins of ingratitude to him, after carrying us through the late war, and giving us liberty, and now so tamely to give it up by adopting this aristocratical government?

Representatives and direct taxes shall be apportioned among the several states which may be included within this union according to their respective numbers. This seems to imply, that we shall be taxed by the poll again, which is contrary to our Bill of Rights. But it is possible that the rich men, who are the great land holders, will tax us in this manner, which will exempt them from paying assessments on their great bodies of land in the old and new parts of the United States; many of them having but few taxable by the poll. Our great Lords and Masters are to lay taxes, raise and support armies, provide a navy, and may appropriate money for two years, call forth the militia to execute their laws, suppress insurrections, and the President is to have the command of the militia. Now, my countrymen, I would ask you, why are all these things directed and put into their power? Why, I conceive, they are to keep you in a good humor; and if you should, at any time, think you are imposed upon by Congress and your great Lords and Masters, and refuse or delay to pay your taxes, or do anything that they shall think proper to order you to do, they can, and I have not a doubt but they will, send the militia of Pennsylvania, Boston, or any other state or place, to cut your throats, ravage and destroy your plantations, drive away your cattle and horses, abuse your wives, kill your infants, and ravish your daughters, and live in free quarters, until you get into a good humor, and pay all that they may think proper to ask of you, and you become good and faithful servants and slaves. (1) Such things have been done, and I have no doubt will be done again, if you consent to the adoption of this new Federal Government. You labored under many hardships while the British tyrannized over you! You fought, conquered and gained your liberty - then keep it, I pray you, as a precious jewel. Trust it not out of your own hands; be assured, if you do, you will never more regain it. The train is laid, the match is on fire, and they only wait for yourselves to put it to the train, to blow up all your liberty and commonwealth governments, and introduce aristocracy and monarchy, and despotism will follow of course in a few years. Four-years President will be in time a King for life; and after him, his son, or he that has the greatest power among them, will be King also. View your danger, and find out good men to represent you in convention - men of your own profession and station in life; men who will not adopt this destructive and diabolical form of a federal government. There are many among you that will not be led by the nose by rich men, and would scorn a bribe. Rich men can live easy under any government, be it ever so tyrannical. They come in for a great share of the tyranny, because they are the ministers of tyrants, and always engross the places of honor and profit, while the greater part of the common people are led by the nose, and played about by these very men, for the destruction of themselves and their class. Be wise, be virtuous, and catch the precious moment as it passes, to refuse this newfangled federal government, and extricate yourselves and posterity from tyranny, oppression, aristocratical or monarchical government. . . .

Governor McDonnell Highlights 2013 Checkpoint Strikeforce Campaign

Commonwealth Touts Five Consecutive Years of Declining DUI Fatalities

RICHMOND –Governor Bob McDonnell today joined Virginia State Police, local law enforcement and highway safety leaders to highlight the ongoing 2013 Checkpoint Strikeforce campaign, which kicked off in the Commonwealth over Labor Day weekend.  During the event, law enforcement held a demonstration of exactly what goes into identifying and apprehending drunk drivers in the Commonwealth. Officers put volunteers through the enforcement elements of a standard field sobriety test, a preliminary breath test and more to showcase the techniques responsible for helping reduce Virginia’s alcohol-related fatality numbers year after year.

2012 marked the fifth-consecutive year of declining drunk driving fatalities in Virginia, which are down over 35% since 2008 (35.31%, 354 > 229). Last year, 229 people were killed in alcohol-related crashes, a more than six-percent (6.53%) decrease from 2011. However despite the progress achieved, drunk driving still accounted for nearly 30% (29.54%) of Virginia’s total traffic fatalities in 2012. This year is already trending in a similar direction, with Virginia’s same number of alcohol-related traffic fatalities (144) recorded as of August 2013 as was recorded as August 2012.

“While we are very encouraged by the progress made in recent years through our law enforcement efforts, by no means have we declared victory in the battle against drunk driving,” stated Governor McDonnell. “Until the day comes when Virginians are no longer threatened by the dangers of this senseless crime, we must remain diligent in our efforts to prevent such crimes through education and enforcement.”

Linda Jackson, Director of the Virginia Department of Forensic Science, was also on hand to explain how accurate forensic alcohol testing and the expertise of scientists from her agency assist law enforcement in the investigation of suspected drunk driving. “With very few exceptions, the numbers tell the story, and yet, too many drivers tragically endanger themselves and others by driving while impaired by alcohol,” said Ms. Jackson. “Forensic testing can help prove a case of impaired driving, but only the driver can prevent it from occurring in the first place."

Started in 2002, Virginia’s Checkpoint Strikeforce campaign is part of a research-based multi-state, zero-tolerance initiative designed to get impaired drivers off the roads using checkpoints and patrols along with education about the dangers and consequences of driving while intoxicated. While the campaign aims to reach all potential drunk drivers, they specifically focus their attention on males aged 21 to 35, a demographic representing nearly a third (31%) of all persons killed in Virginia’s alcohol-related traffic crashes last year.

In addition to a significant multimedia campaign featuring more than 40,000 campaign ads running on nearly 90 television, cable and radio stations in Virginia, Checkpoint Strikeforce incorporates a stepped-up law enforcement effort to promote a multijurisdictional fight against drunk driving. State and local police increase visibility through sobriety checkpoints and saturation patrols. Last year, 28,719 people were convicted of DUI in Virginia, a nearly two-percent (1.98%) increase from 2011.

MWR Strategies, a Richmond-based research firm that has conducted Checkpoint Strikeforce campaign surveys since 2002, conducted a public opinion survey of 800 drivers in Virginia, Maryland and the District of Columbia in August 2013 (including an oversample of 300 area male drivers ages 21-35). Among the latter, campaign’s targeted audience, key findings include:
·         Drunk drivers remain one of the leading “serious dangers” facing both all age (67%) and 21-to-35-year old (60%) drivers.
·         The overwhelming, most-feared drunk driving consequence of 21-to-35-year old drivers (70%) is the “killing or injuring someone else.”
·          “Stricter laws” are the leading deterrent thought by 21-to-35-year old drivers (24%) to be “most effective at preventing people from driving drunk.”
·         Over three-quarters of 21-to-35-year old drivers (76%) have exit strategies in place (as to how best to get safely home at the end of an evening).
·         Popular means by which 21-to-35-year old drivers use “to get home safely” include: designating a driver (75%); sleeping at a friend’s place (68%); taking cabs (62%); sticking to “bars that are walkable” (51%); and taking transit (49%).
