Virginia Attorney General; Private Law Firm For State Officials Only?

This was recently sent to us by one of our readers.  It shows something rather disturbing and it comes straight out of the Virginia Attorney General, Mark Herring's, office.  We are reprinting the message below.

Thank you for contacting the office of Attorney General Mark Herring.  We appreciate your taking the time to write to our office.

            The Office of the Attorney General functions as the law firm for state government and does not provide legal advice to private individuals.  The Office advises state officials and represents the various state agencies and departments, as well as renders opinions at the request of state officials.  Due to statutory restrictions, conflict of interest rules and other policy considerations, we are unable to render private legal advice or otherwise assist citizens in legal matters. 

            Having said this and after further review of your letter, I regret that this Office does not have the jurisdiction to assist in this matter.  I encourage you to reach out to the Virginia State Police for assistance with this investigation.

            If our office can be of further assistance, please do not hesitate to contact us.

The name of the reader that this was addressed to has been removed.  Now this is where it gets interesting.  The reason for the contact had nothing to do with asking for legal advice.  It asked specifically for an investigation into interstate fraud.  Looking at the statement coming out of Mr Herring's office, it would seem that the statement made is that the Attorney General's office here in the state of Virginia is to serve only as the private law firm for state officials.  

Let's take a look back in time to about the year 1902.  We are going to quote straight from a text book that was written about the Virginia Constitution.

ATTORNEY-GENERAL.
 Elected. By the people for four years. Salary, $2,500 and mileage. Duties. Shall give his opinion and advice when required to do so by the Governor, or by any of the public boards and officers at the seat of government; shall appear as counsel for the State in all cases in which the commonwealth is interested, depending in the Supreme Court of Appeals, the Supreme Court of the United States, the District and Circuit Courts of the United States for the State of Virginia, and shall discharge such other duties as may be imposed by the General Assembly.

 Member of the State Board of Education. An attorney is a person who acts for and in the place of another. The word is usually applied to a lawyer who is employed by another to act for him in any law business he wishes to have done. An attorney who appears in a court of law and acts or defends a person, or acts against a person accused of crime, is called a counsel.

 The attorney-general is a lawyer who is elected to do law business for the State. He must appear in court as counsel for the State in every case in which the commonwealth (meaning the whole people) is interested. The commonwealth is interested in every case of crime, because it is for the interest or well-being of the people that those who commit crime should be punished. If this were not done— if criminals, persons who commit murder or burglary or theft—were not arrested and punished, no man's life or property would be safe. The attorney-general must appear and act for the commonwealth in any of the courts above mentioned whenever there is a case in any of them in which the people of the State are interested.

Now maybe this is why we have Commonwealth attorneys throughout the state.  But it does not answer why this office should not be looking into any issues of Interstate fraud.

Let's now look at what the online information says about the duties and responsibilities of the Virginia Attorney General.

Duties

The duties and powers of the office of the attorney general include:[1]
  • Provide legal advice and representation to the Governor and executive agencies, state boards and commissions, and institutions of higher education. The advice commonly includes help with personnel issues, contracts, purchasing, regulatory and real estate matters and the review of proposed legislation. The Office also represents those agencies in court.
  • Provide written legal advice in the form of official opinions to members of the General Assembly and government officials.
  • Defend criminal convictions on appeal, and defend the state when prisoners sue concerning their incarceration.
  • Defend the constitutionality of state laws when they are challenged in court.
  • Enforce state laws that protect businesses and consumers when there are violations. Individual consumer complaints are usually handled by another agency.
  • Represent consumers in utility matters before the State Corporation Commission.
  • Collect debts owed to state agencies, hospitals and universities.
  • Conduct or assist criminal investigations and prosecutions in certain limited cases (for example Medicaid fraud, money laundering, theft of state property, environmental crimes, and computer crimes).
  • Represent the Department of Social Services in its efforts to collect child support on behalf of children and families.
  • Supervise the appointment and payment of private attorneys hired by other state agencies for various matters.
  • Assist victims of crime who are following criminal cases at the appellate level.
  • Provide information to the public on Identity Theft prevention and remediation.
  • Administer grants to help reduce crimes involving gangs, drugs and sex predators.
  • Administer the Sexually Violent Predator Civil Commitment Program to protect children from the most dangerous predators.

But our present Virginia state Constitution says as follows;

Section 2. People the source of power.

That all power is vested in, and consequently derived from, the people, that magistrates are their trustees and servants, and at all times amenable to them.

The Virginia Attorney General is an elected official.  That means he is a servant of the people, not the private law firm for state officials only.  Yet as we move more to a total socialist nation, we are seeing that the term elected official no longer has any real meaning to it other than our rights no longer exist.  It's right there in the history before your eyes.  One could argue that society has become more complex and therefore the need to limit powers to this office is much needed.  It's an argument that does not stand.  More complex than what?  It's always been complex.  The bottom line is this, that answer that came out of Mark Herring's office is unacceptable.  At the very least, a contact person should have been setup for the person and the information passed on to the office recommended.  It was not.  Why?  Was his office trying to send the person who contacted them on some kind of wild goose chase and good luck, don't come back situation?  

  Did someone just decide they did not want to do something that resembled work?  Imagine.

Gloucester County Attorney Ted Wilmot Tells Local Residents He Ins't An Attorney While He's In Office?

We need to go back to an earlier story found only on this site as no one else wanted to report it.  (Why we keep saying, what you won't read anywhere else).

http://www.gloucestercounty-va.com/2013/01/animal-control-code-law-ordinance.html  This is an internal link to a story about how Gloucester County, VA animal control ordinace section 3-15 was in violation of Virginia State law.  Ted Wilmot knew this and was working at the county level to amend the ordinance.  However, that did not stop him from prosecuting Gloucester, Virginia's largest animal control case in it's history.  At least on paper record.  Problem was that 20 out of 26 charges were under section 3-15 that itself was within state code violation.

Now for the story;  Earlier this week the couple of women with these outrageous charges against them went to pay on the fines from this case.  They asked the court clerk if they still had to pay the costs since what they were charged with is no longer a law.  (Old ordinance as it stood did not stand the test against state code), the clerk recommended that the two ladies speak to Ted Wilmot, the county attorney who prosecuted the case.  She told them where his office was and so they went to see Mr Wilmot and find out the answer.

  Here is what happened;  The two ladies introduced themselves to Ted once in his office.  They asked him about still having to pay the fees since what they were charged with was not an actual legal ordinance.  Ted first told them that he did not remember them.  He then went on to tell them that he did not remember the case.  Afterward he then went to explain to them that he was not an attorney.

    The two ladies pointed to his door sign, "Ted Wilmot, County Attorney", and then he ignored them.  The two ladies have told us that he was twitching the entire time they were there.  The mouth lies, the body does not.





It seems Ted (The Twitcher) Wilmot was staying true to form.  Advice for any attorney or anyone meeting Ted in court, watch Ted's body language very closely, he can not maintain control over it while his mouth is not agreeing with him.

  Now if that does not make you mad, consider this.  The Gloucester County Board of Supervisors saw fit to give Ted a raise recently.  Over $6,000.00 worth of a raise in fact.  Ted is now earning over $126,000.00 per year and he is treating local residents like this?

  Questions we have is why the county is giving raises in this economy, (not that a great deal of county employees do not deserve it as they do), especially after hearing the concerns of local residents and not raising taxes this past year because of public outrage.  The county was crying that it needed the money.  Who reading this has gotten a $6,000.00 raise this year?  Another employee received over $8,000.00 in a raise recently as well.  That's $14,000.00 in raises to two employees in the county alone.

  The county is also working on plans to raise your taxes before the end of this year on other foolish ideas.  Federal employees in the area have just been laid off for the next 11 weeks creating very serious financial hardships and they still have to pay the taxes on the county's spendthrift plans?  We know a number of federal employees who are getting more outraged by the day over the board of supervisors plans.


If Ted does not remember that he is an attorney, is he suffering from early stages of dementia?  If he was twitching while talking to these two ladies, does he have early stages of Parkinson's disease?  Is Ted Wilmot fit to continue in his role as county attorney? This is your tax dollars working hard.  Either way, Ted has now earned the nickname from us as either Twitching Ted or Ted, The Twitcher, Wilmot. 

Is this fact or is this fiction?  It's Ted's word against these two ladies as no one else was in the office with them.  The two ladies ended up paying the fine as they really do not want any more trouble.  A fine that never should have been assessed against them from what we see and in our opinion.

Gloucester, VA Sheriff's Race - Two Candidates Now On The Ballet

Clarence Bowser and Darrell Warren are the two candidates now seeking election this fall for the Sheriff's position.  Clarence Bowser is running as an independent and Darrell Warren is running under the Republican platform.  There are no other challengers to Darrell Warren from inside the Sheriff's Office this time although Clarence Bowser is an ex sheriff's deputy from the Gloucester County Sheriff's Office.

This is not the first time Clarence Bowser has run for this position but he gets very little local press compared to other candidates in past campaigns.  Clarence has written a book and it is available on Amazon.  The name of that book is Penalty of Justice: The Pro Se.  CLICK HERE to see the title on Amazon.  You can also read a good section of the book to get a feel for it right on the Amazon site.

Gloucester, VA Courts To Create Conflict of Interest?

At this point, we have to ask the question as to who is going to hear this case from the articles below this one.  Will it be Judge Shaw?  If so there will be a clear conflict of interest as Judge Timothy Shaw was the judge in the case that we have been reporting on.

https://sites.google.com/site/gloucestervanews/  This is the link to the full story.  With published complaints against Judge Shaw on the way he handled the case, it would be an extremely clear conflict of interest.  Will it be Judge Long?  We have no personal issues with Judge Long however again, it is fair to claim a conflict of interest as Judge Shaw and Judge Long were and may still be business partners that also included Michael T Soberick who is the attorney we have also published serious complaints about.

  In fact, pretty much any Gloucester County Judge can be fairly claimed as a conflict of interest.  Gloucester County would be well served finding a judge from outside of the county with no discernible ties to any of the local judges or anyone in the local county government.  The court date and time is this Thursday, August 2nd, 2012 at the Gloucester County Courthouse at 3:00 PM.

  Special invitations have already been sent out to Delegate Kieth Hodges and commonwealth of Virginia senator Tommy Norment of the 3rd district to view this proceeding and watch out for any potential conflicts of interest as well as watch out for Gloucester County officials potentially once again making up their own laws as they go along.

  Other members of the press are being sent special invitations to attend this proceeding as well.  Anyone with an interest is also invited to attend to see how the county handles this matter.  At present, numerous Commonwealth Officials are being asked to investigate the corruption of Gloucester, VA officials from the Gloucester County Sheriff's Office, Gloucester, VA Animal Control, Gloucester, VA court clerks, several Gloucester County Commonwealth attorney's, potential corruption of county judge, Judge Shaw, local attorney Michael T Soberick, Holli M Cohoon, and others based on the evidence presented on this site as well as the linked site above and a special locked site where evidence is presented that will not be made public.

  Complaints have been sent to Kenneth T Cuccinelli II, Virginia Commonwealth Attorney General, Virginia Governor Robert F McDonnell, Delegate Kieth Hodges, Commonwealth Senator Tommy Norment, 3rd District of Virginia, the Virginia State Police, and the Newport News division of the FBI.

Is Holli Cohoon Stalking This Victim? Gloucester, VA Board of Supervisors Do Not Deny Corruption

One of our team members posed an interesting legal question that we just are not able to answer.  How did Holli Cohoon get the address of the victim in this case?  Did she pull favors from the Gloucester, VA Sheriff's Office who would have then illegally given Holli the victim's private information?  Did the information come from maybe an old friend at the 911 call center who would have had access to pull those files and again illegally gave them to Holli?  Or is someone in the Gloucester, VA Sheriff's Office using Holli as a front?

  Here are some interesting points.  We sent detailed information about this case to the Gloucester, VA Board of Supervisors.  We received confirmation that they received the emails.  They have done nothing about the information about the case hence they do not deny the corruption.  Because we have shed a lot of light on the corruption of the Gloucester County Sheriff''s Office, Gloucester County Animal Control and a number of members of the court system and even the county attorney, Ted Wilmot, this looks like a way in which they are trying to stop the news from coming out.  Did we get to close to some other corruption?  Property tax abuses or something else?

Go back and look at Holli's court testimony against the victim in this case and listen to the 911 call.  They do NOT match up.   In fact, we contracted a professional 911 operator who explained in detail to us every area on the 911 recording that protocol was thrown out and nothing on that call could have been authentic in any way.  The recording was a complete violation of 911 procedures.  https://sites.google.com/site/gloucestervanews/segment-3  This is a link right to the 911 call recording as provided by the Gloucester County, VA Sheriff's Office and used in court.

Holli M Cohoon Now Harassing Victim?

Is Holli M Cohoon now harassing the victim she gave highly questionable testimony against?  

Let's go back to the beginning on this.  Holli M Cohoon was once a 911 operator for the Gloucester, VA Sheriff's Office.  We have been reporting for some time now on this case and we have shown that at the very least, Holli has lied in court.  Now all of a sudden from out of nowhere, the victim gets this emergency protective order a few days after we released a story on Holli and her Sunrise Donut shop.

  The victim in this case was initially raided by the Gloucester, VA Sheriff's Office, under Sheriff Steve Gentry, and Gloucester, VA Animal control without a search warrant.  A search warrant was not issued to this victim until later in the day after she was released from jail.  This victim had no idea was she was even taken to jail.

We have shown that the search warrant that was given to the victim after being released from jail was not valid in any area of law.  We showed also that this victim had all kinds of false evidence used against her by Gloucester, VA Animal Control and the Gloucester, VA Sheriff's Office.  We show that Holli's testimony was no where near the other false evidence given by others presenting further false evidence.
We have shown how the evidence is false.

  The victim in this case has been working on a lawsuit against Holli M Cohoon for some time now and it is opinion that Holli may have gotten wind of a pending lawsuit and is using this as a way to throw off the case.  So is this a harassment attempt by Holli?


 When putting together a lawsuit, you get detailed information on what the other party owns in order to determine if the lawsuit can be justified.

Now here is some other information we find very interesting.  We went over the above document with a fine tooth comb and see that Gloucester County court officials followed everything to the letter of the law.  Now how is it they can do this now but were unable to do this in the past?  Every area properly signed, every aspect properly dated and executed.  Yet on the search warrant given after the raid on the victim, nothing was done properly.  Go back into our archives and see for yourself.  We posted that evidence.  Or Click Here to see all the evidence from this case.

GLOUCESTER, Va. (WAVY) - The Gloucester County Sheriff's Office has released the names of a man and woman found shot to death inside a home Friday evening.
Investigators say it is an apparent murder/suicide.
Gloucester County Sheriff’s Office spokesman Lt. Scott Little said family members called deputies around 6:30p.m. to check on Neville Jackson, 85, and Mary Jackson, 79. They arrived to find their bodies inside the home in the 6900 block of Ware Neck Road.

The main Gloucester County, VA web site with the dot info extension is using an old SEO trick to help stave off negative press from showing up in search results.  Why?  Because we are producing a lot of negative press about Gloucester County, VA Animal Control, Gloucester County, VA Sheriff's Office, Circuit Court Office and staff and now the Board of Supervisors.  The concept is to push other sites down by flooding the search engine with pages on your own site.  Gloucester has deep pockets, even though they happen to be yours.  So what we are doing in response to all of this is recoding our posts to move back up into the search results.

Gloucester Sheriff's Office Produced False Meta Data File On Audio

The above picture is from the 911 call and is the audio meta data as produced in a CDA file by the Gloucester County Sheriff's Office in the case we have been covering.  The meta data is a false report.  For the incident that occurred on May 4th, 2010, this meta data says that the recording took place on December 31st, 1994 at 8:00 PM.  Now how could that possibly be?  The Sheriff's Office is expected to comply with the laws no different than anyone else.  In fact, it is their job to exceed expectations and lead the way.  Why then are they producing false meta data on digital files?   We have said that the files were altered and this is just more proof of those alterations.  A CD audio file is in fact a digital file.  And once again, we see that Monique Donner, Esq, Ted Wilmot, Esq, and Michael T Soberic, Esq, did not do their jobs in checking the facts in this case.  The meta data should have been looked at and highly questioned then thrown out as having no validity unless the Gloucester County Sheriff's Office could have shown a sound reason why the meta data was so far off.  Then the case should have been moved to a latter date until the Gloucester Sheriff's Office could produce a legal file.  But that couldn't be done because the recording was altered and illegally used anyway.

Gloucester Animal Control Audio Audit Testing Shows Serious Issues


The above audio shows some very serious issues with the Gloucester Animal Control file DW_C0152 and Steve Baranek's claims about the audio.  We were granted permission by the victims in this case to go back to their property and conduct a number of simulation tests.  Our objective was to see if any area of the audio could be even considered somewhat authentic.  All of our simulation tests failed to show any accuracy with the audio, DW_C0152, as could have possibly happened the way the audio claims it did.  We loaded the audio onto one of our tablets and tried numerous recreations to validate any area of the audio.  Every simulation we tried just did not stand up.

  Let's start with this above audio.  Steve Baranek would have you believe he is driving down a road and then into the driveway of the victims property.  Yet you do not hear any motor running nor do you hear any tire road noise.  In fairness, we cut out tiny sections of audio file DW_C0152 where the victims names and later address was used.  In our own simulation, we used a pocket recorder like Steve was using.  It's a Sony digital recorder.  We did not talk during the taping as we were just looking to see if we could even pick up any road noise.  Sure enough we picked up all the road noise, the turn signal used to turn into the driveway, the difference in the road noise between the main road and the driveway, all the sounds of turning off the engine and opening and closing our doors.  We were in an SUV for our tests.


  What we also find very interesting is the photographic evidence above.  If Steve was the first person at the gate, as he states when he is pulling up, that the gate looks like it is locked, why is the first car in this picture a Gloucester County Sheriff's Office patrol vehicle?  Also, how could Steve see the gate with this patrol vehicle in the way?  Super human powers?  So just within the first thirty seconds alone, we see evidence that Steve Baranek started manufacturing false evidence.  He was not driving in a vehicle as he would have others believe.  That means everything beyond the first thirty seconds is without question garbage.  It's meaningless.  Has no use and no value.  The moment Steve Baranek started recording was a complete sham.    And still we have so much more on this.

Holli M Cohoon's Time Now Officially Up

Holli M Cohoon was offered a special deal if she would come forward and tell the truth about the 911 call recording and her testimony.  Holli was the 911 dispatcher in this case.  In an earlier post we showed how the 911 recording does not match her testimony and the 911 call also does not match Animal Control's file DW_C0152 audio.  So we know that all the evidence is falsely manufactured.  We gave Holli 2 weeks to come forward with the correct information on all of this.  Well her time is up and the offer is now fully withdrawn.  She can now be fully accountable for her testimony and her place in this case.
