Capias Fraud In Gloucester, Virginia?

Above is a Capias used to arrest a local resident.  Problem is from everything I have read in the Virginia Criminal Justice rules, the above Capias was illegally put together and executed in my opinion and I will go over why here very shortly.  I am also including the Virginia Department of Criminal Justice Rules so that everyone can read them and make their own interpretation.

Now on page 7 of the above document it shows three areas in where a Capias may be used.  Those three areas are as follows:  Failure To Appear, Contempt of Court, and Failure To Obey A Court Order.  Now a Capias may be issued for the arrest of someone who has been indited by a grand jury on felony charges, but not on misdemeanor charges.

  In the top Capias, the defendant was ordered to be arrested for two very vague accusations of statutory violations that are both misdemeanors.  When you read the Virginia rules here, you will see that the most the court may do is issue a summons to appear to the defendant.  The only way this defendant could have been arrested is if she violated some court order, but she was not in court and has no court orders against her.  She did not meet any contempt of court order as she was not yet put before any court.  There was no failure to appear as she had not been issued any form of notice.

  So how and why did they arrest her?  This is the only document used for her arrest along with two True Bills of accusations of statutory violations made against her.  No arrest warrant(s) were ever issued or executed nor any summons ever given.  Also, the rules state that only a court clerk, magistrate, or judge may sign a Capias depending on how it is being created and for what purpose.  In this case it was signed by a deputy clerk and not the court clerk.

  It begs me to ask: are the courts somehow exempt from their own rules that they create?  I am pretty darn sure that the courts, judges whom have sat over this case and the clerks are all aware of this and this may be a very big part in why they are demanding that the defendant go through a mental evaluation.  The entire case in my opinion is based on retaliation against us and predicated on fraud throughout.  Much more coming.

Gloucester, VA Why Teachers Are Not Getting Raises?



The above school board vehicle was at Hardee's restaurant this morning, August 27th, 2014 at 8:24 AM.  Vehicle number was badly damaged and we could only make out 27 as in vehicle number two hundred and seventy something.  No rare state plate was visible on the vehicle at all.  The two guys inside were waving to us as we took their pictures.


The above pictured vehicle was seen yesterday at 7-Eleven across from Hardee's restaurant in the Courthouse Area.  This vehicle is registered to Dave Miller and the person in charge of this vehicle?  Dave Miller.  This van is seen all the time stopping everywhere.  We have more pictures of this van than any other county vehicle.  It belongs to the school board of course.

  No other county vehicles were seen at restaurants, stores or other quick market stores recently.  This would seem like one of many reasons teachers in Gloucester County Public Schools do not seem to get well deserved raises.  School board admin and support staff like to waste money.  Over the years, the school board has convinced the teachers that it's the Board of Supervisors who are responsible for teachers not getting raises and the school board each year marches a host of teachers and students before the board of supervisors to complain about not having enough money.

  What a scam in our view.  Let's look at some basic facts, the school board has been getting steady increases every year while student enrollment has been falling.  The school board has increased it's administrative staff to an enormous size, wasted millions of untold taxpayer dollars on renovating an old school for their own facilities that is way to large for their needs, but to small for all their wants, wasted even more millions building a new school that simply was not needed, all so certain people could get fatter checks all the while ignoring the basic needs of the teachers and hence, the students.  More typical hypocrisy from the top here in Gloucester County.  Waste at so many levels and we are fed a mantra that it's all for the children.  No it's not.  It's all for the few and screw you.  Buy their hype and BS all you want, it's not about the children no matter how many times they try and sell you that song.

  The waste must stop.  So we will keep digging and posting all that we find.  It's time for the teachers of Gloucester County to hold the school board accountable and stop buying the garbage they want to sell you.

Gloucester, VA FOIA Fraud?



Watch the above video all the way through if you can, it's about 4 hours long, but to make a long story short, we were at this meeting and we watched everything going on during the entire meeting.  Here is what we sent to Mr Chriscoe, Board of Supervisor member at large.

"Mr Chriscoe:  We are going to FIOA your text messages made and received during the BoS meeting.  We not only saw what you were doing, we also heard your phone going off numerous times.  Thought there was a policy passed last year that prohibited this.  Since it was done during a BoS meeting, it becomes BoS business.  May we suggest you refrain from this in the future?"

A response from Mr Chriscoe;

My phone did not go off during the meeting.  I did receive a text during the meeting, not pertaining to county business.  I also used my phone as a calculator during a portion of the meeting.  I do not send texts during meetings of any kind they are sent automatically by the meeting setting on my phone.

Thank you for the interest in what I do.  Sorry to disappoint.

Our Response;

" All we can do is go by what we see and hear.  Your phone seemed to have beeped numerous times during the meeting.  Also, your claim that you were making calculations is of concern as you did not bring up any numbers during the meeting that would release you of such a claim.  May we point out that appearance should always be a concern that must be taken into consideration at all times during a Board meeting.  Also, conversations with numerous people after the meeting, the consensus was unanimous, that the appearance was you were texting during the meeting.  

  We are not trying to be offensive to you.  We are showing you what we are seeing and are simply asking for transparency.  Please go back and review the meeting video and take an honest look at yourself and ask what it is that everyone else is seeing."

Again Mr Chriscoe Responds;

I understand your point.  My harshest critic watches all of the meetings.  And at no time did my mom say anything about my phone.  She says I am an on it all the time and she made no mention of it.  I do keep my phone silenced and if I do get a text I get a green light that blinks.  My mother is a widow and I have two kids at home.  If something happens to one of them someone can always get a hold of me.  At our next meeting if you are there I will show you the feature I use so that the phone does not vibrate or make a sound.  I apologize if it looked like I was using my phone. 

I did have to use my iPad during the meting because the laptop on the counter quit working prior to the meeting.

There is an old saying that we have adopted here.  Trust but verify.  So as we stated, we did a FOIA request for any and all text messages.  It went like this.

"Hello Christie;

  Attached is a PDF formal FOIA request for information regarding any and all text messages sent and or received by Ashley Chriscoe during the July 1st, 2014 Board of Supervisor's meeting between the hours of 7:00 PM and 11:00 PM.  As always, thank you for everything that you do."

The response back from Christie Lewis is as follows.

I am in receipt of your attached FOIA request as emailed and received on Tuesday, July 8, 2014 for “ digital copies of any and all text messages of Ashley Chriscoe during the July 1st, 2014 Board of Supervisor's meeting between the hours of 7:00 p.m. and 11:00 p.m.” 

Mr. Chriscoe has indicated that he reviewed all text messages and only one text message was received and one was sent through automatic response during the timeframe specified.  These texts were not related to public business and do not constitute public records as defined under “Public Records” in the Code of Virginia § 2.2-3701.

FOIA provisions allow a locality to charge a reasonable fee to access and search for requested records.  Total time being charged for this request is 45 minutes at a rate of $15 per hour for a total charge of $11.25.  Please remit payment by check made payable to the “County of Gloucester” for the total amount and mail to Gloucester Community Education, P.O. Box 1306, Gloucester, VA 23061 or you may bring payment in person to our office.  We ask that you call ahead to 693-5730 to ensure staff is available to receive payment.  We are unable to make change, so we ask to please bring the exact amount if paying in person.

We asked for a justification of the above expense as Mr Chriscoe had already went through his text messages prior to the request.  How can he have possibly spent one hour once again reviewing his messages and why would it take anyone so long?  Also, let's look at the facts.  Christie Lewis only asked Mr Chriscoe for any digital copies of any text messages that he may have sent or received during the time frame in question.  She did not search any phone records to verify anything.  She simply asked him for any records.  So we have no idea whether or not he is even telling the truth.  

  Second.  Christie Lewis asks Mr Chriscoe how much time he spent searching his phone records and just goes along with that.  No verification on time spent here either and all this after Mr Chriscoe already told me the same story prior to the FOIA request.  Does anyone wonder why we question the integrity of local government officials?  Here is more of the conversation.

Another email to us from Christie Lewis;

"Mr. Chriscoe indicated he spent approximately one hour reviewing and responding to your request.  The county guideline is to provide a courtesy 15 minutes of response time so we billed for 45 minutes at the clerical rate of $15 per hour."

Our response to this is as follows:

"Please ask Mr Chriscoe to justify his time spent going through his cell phone for one hour after having already provided information on such prior to said request."

Again, we were at the meeting and kept hearing cell phone tones that would indicate a message came in on someone's phone during the meeting and it was coming from the front of the meeting room.  Mr Chriscoe had his head down and looking at something in front of him throughout a great deal of the 4 hour meeting.  It looked as though he was in fact texting.  We tried to work with county officials to clear all of this up, but there has been no response to us from the last email we sent asking Mr Chriscoe to justify his time spent looking through his cell phone messages or was that possibly deleting his cell phone messages?  We are presently looking into potential fraud on this.  This is not what we expect nor is it what anyone should expect of any county officials at any time.  It's disgraceful.

Gloucester, VA County Employees Continue To Shop On Your Tax Dollars


Monday, May 12th, 2014, we saw this county government vehicle pull into the parking lot and the employee go into Dollar General at about 10:30 AM.  The employee was in the store for about 15 minutes.  Why are county employees going shopping when they are supposed to be working and again as we continue to point out, in violation of county employment policies no less.  If they had to buy supplies, for one, this is not the way the county should be spending money, they have catalogs where they can order whatever goods they need and spend less money and pay no taxes than buying from national retailers.  Which also brings up the next question, if they are buying supplies in this way, are they paying taxes using money we paid in taxes for them to waste like this adding extra burdens on us all?

  If this was personal shopping, why are we paying them to shop and drive all over the county to do so?  It does not look like this issue will ever be solved.  The county government thinks your pockets are so deep that they can spend all your money any way they see fit?  This after the Board of Supervisors spent a great deal of energy holding the line to prevent taxes from going up?  Something has to give and it may just be your wallet in the next round come 2015.

Gloucester, VA A Letter From The Kiser, School Board Superintendant

I am in receipt of your complaint alleging a violation of policy regarding an employee driving a School Board-owned vehicle. The School Board Policy reads “Employees are prohibited from utilizing school property for personal use or gain.” School Board owned vehicles are provided to employees to use during the work day to accomplish tasks throughout the county at 8 different schools. Most of our vehicles are used vehicles with high mileage and the availability of these vehicles, for employee use, actually saves the county money and time. This resource also creates efficiency with our technicians moving from site to site.



Our Director of Facilities manages our technicians, their schedule, and the use of vehicles. He continually has conversations with them about how they use the vehicles to ensure that taxpayer money is not abused. We do not consider a technician occasionally stopping at a convenience store between sites or at a fast-food restaurant between sites as abuse or a violation of the School Board Policy.



Our technicians begin their days early and work hard to ensure that schools are safe and orderly for children and staff. We take our stewardship responsibility of public monies seriously and your pictures have been shared with our Facilities Director.

This was sent to us and it speaks for itself.  We had no idea that a straightforward law was open to such broad interpretations.  VDOT does not seem to share these sentiments from what we have learned.  Neither does the county from emails we have gathered.  Yet the schools consider themselves exempt from having to follow what everyone else in the state has to follow in state government?  Wow, that is simply amazing.  

  Guess the Kiser failed to factor in the potential insurance consequences should an employee cause an accident in an area where he was not designated to be and conducting personal business?  From what we understand, no insurance company would be obligated to pay anything on a claim because of the above.  Instead, the county would get stuck with the bill which means that you, the taxpayer pays the claim through taxes.  That is not abuse?  That is not fraud?  We do not discount that the employees work hard.  We are sure they do.  But that should exempt them from state laws how?  

We take our stewardship responsibility of public monies seriously .

Can you then please explain to us the Page Middle School issues then?  We simply do not see this statement as factual and we keep uncovering still many more issues that will soon be coming forward.  For that matter, can you explain the issues with the TC Walker school?  At least the Kiser sent this response through his county assigned email address.  Yeah, we are watching.

Clear evidence that county officials have no problems with conducting
county business using personal email addresses.  Evidence is right in
front of everyone.  So what are they hiding?  You really have to wonder.

Gloucester, VA County Truck Number 67 At McDonald's Again



































Parks and Recreation truck number 67 was seen again at McDonald's this past morning, Monday, December 16th, 2013 at about 8:15 AM.  This is the same truck that was here last week on Monday.  Below is the county employment code from the county's own website.  Chapter 13 of the employment code.

Section 13-27: Use of County Vehicles

County vehicles are provided for the use of employees and authorized
volunteers in conducting official business of the County. Personal use of County
vehicles is prohibited. Certain employees are required or allowed to take a County
vehicle home at night, as they are required to respond to the needs of the County
outside of normal business hours. Take home vehicles must be approved by the
County Administrator who shall maintain a current record of all authorized take home vehicles.

Operators of County vehicles should practice “defensive driving” and
anticipate and observe the actions of other drivers and control their own vehicle in
such a manner so as to avoid an accident. Operators of County vehicles and all
passengers therein shall properly use seat belts at all times. Injury resulting from a failure to wear seat belts may constitute gross negligence on the part of the individual and upon case review may jeopardize an employee’s eligibility for relief normally provided under the worker’s compensation or disability claims.

Above is the link to the information so everyone can verify this for themselves.  We don't make this stuff up.  For 8 months we have been reporting this abuse.  For 8 months the abuse continues with nothing being done about it.  It would seem fair to say that Brenda Garton, county administrator and Ted Wilmot, County Attorney are not doing their jobs but are instead failing to do their jobs in protecting the county, the taxpayers and the Board of Supervisors from waste, fraud and abuse as well as increased costs and expenses as well as increased liabilities.  We have filed a complaint form with human resources about this employee who is very clearly in violation of the above policy.

  Since it is clear that neither the county administrator nor the county attorney are capable of doing their jobs, they should be termed for cause without any further form of compensation whatsoever.  One also has to question the department heads as to why they are unable to properly communicate to their own employees what the policy states and then make sure that the employees maintain this agreement.  The above employee driving truck 67 has already been reported and nothing has been done about it.  Employees continue to use county vehicles for their own personal use all the time with no regard for employment policies and the county officials are letting them?

Gloucester, VA County Employees Continue To Abuse Taxpayers




























6:45 AM Monday morning, December 9th, 2013 this county auto was seen at McDonald's.  The giveaway that it's a county employee?  The license plate.




























8:30 AM.  Parks and Recreation vehicle number 67.  Monday morning December 9th, 2013.

We will give some credit, county employees have slowed down being found where they do not belong, but they are still doing this on a daily basis.  We have been out every week and we see them every week.  We are not always able to get photos though.  Mr Happy Meals on Wheels from the county school system has been seen at 7-Eleven and McDonald's numerous times but has managed to evade our cameras.








Last Monday, December 2nd, 2013 This deputy no sooner goes on duty that he decides that he needs breakfast.  It's McDonald's in Hayes by Farm Fresh.  Now to be fair, these guys do need to eat and they, without question, are stuck in their vehicles throughout most of the day.  It's a very tough job no matter what anyone thinks.  The issue however is grabbing food just after you get on duty?  You could not eat before going to work like everyone else has to?  If we are to look to these people for examples, what are the examples being set?

  We said it before, as long as county employees are out violating the law, we are going to continue to catch them and show everyone how our tax dollars are being wasted.  It is very clear that we have no leadership in the county.  None of the officials have the backbone to stop this waste and abuse and clear violations to the public trust.  Taxes are going up and here is part of the reason why.  We have been reporting on this since April of this year.  That's 9 months now and it's still not under control?  We only report these issues when we have the actual photographic evidence.  Like we said, we have caught plenty of other county employees but they got lucky and managed to avoid our cameras.

  Maybe the new members of the Board of Supervisors will put a screeching halt to all of this come January.  We expect they will.  We have some good people coming in and we are expecting some solid management coming in and moving forward.
