Gloucester, VA Officials Improper Use of Credit Cards?

What we are about to cover comes from sources deemed valid, however, proof is not available so it falls into the category of word on the street.  Therefore we report the following information more as a story of fiction based on information obtained.

Our first story is of one Gloucester official who used a county government issued credit card to finance a personal affair he was having with a person out of the area.  County officials found out about the fraud when the guys wife turned him in.  Charges on the card were for tickets and a county vehicle was being used for personal use in the affair.  What did county officials do?  Nothing from what we were informed other than protect him from the charges.  County officials who wanted him charged were backed off from the case.

  In another story, we have a county official who decided to go out and get plastered at one of the local establishments and at the end of the evening decided to pay for her private party with a county issued credit card.  She made the mistake of leaving the credit card at the local establishment who had to trace her down to give her the credit card back.  Lucky for all of us the establishment has such a professional and dedicated staff to perform such a duty as we all could have been stuck with all kinds of credit card fraud charges.

  What happened to this employee?  Well the employee still has her job.  She just has to live with the story and hope that we never get our hands on it.  How much corruption do we have to report here every week?  Our county officials are out of control at every level and having a party on your dime.  That dime used to be a nickle.  That dime is about to become a quarter.  It keeps getting worse the more we dig and it's now coming in from all over these days.

  What's even worse?  County officials are still balancing the books even with this kind of stuff going on.  Can someone please explain that to us?  And you wonder why your taxes are high and going ever higher?  We never read this part of the Virginia Constitution.

Signing a Contract to sign a Contract? Gloucester Officials Need To Understand The Laws

Open Letter to the Citizens of Gloucester County Virginia


Since County officials are incapable of following the law as shown repeatedly on this blog site; do they think that signing a letter of intent to sign the Contract for the Swamp School is legal before the funding is available?

The Virginia Constitution was written for us to limit the government intrusion into our lives.  Have you ever read the Constitution of the United States?  How about the Constitution of Virginia?

Ҥ 15.2-1238. Certification of sufficient funds.
Except in emergency, no order for delivery on a contract or open market order for supplies or contractual services for any county department or agency shall be awarded until the chief financial officer has certified that the unencumbered balance in the appropriation concerned, in excess of all unpaid obligations, is sufficient to defray the cost of such order.

15.2-1239. Orders and contracts in violation of article.
If any department or agency of the county government purchases or contracts for any supplies or contractual services contrary to the provisions of this article or the rules and regulations made there under  such order or contract shall be void and the head of such department or agency shall be personally liable for the costs of such order or contract.

§ 22.1-175.5. Capital School Projects Fund.

A. The governing body of any locality which is awarded a grant pursuant to this chapter may authorize the local treasurer or fiscal officer, by ordinance or resolution, to create a separate escrow account upon the books of the locality, as described in this section. Upon the adoption of such ordinance or resolution, the treasurer of the locality shall place such grant awards into this account.

B. The escrow account shall be known as the "County/City/Town of ____________ Capital School Projects Fund." All principal deposited to such fund, together with all income from or attributable to the fund, shall be used solely for (i) construction, additions, renovations, including retrofitting and enlarging public school buildings, infrastructure, including technology infrastructure, and site acquisition for public school buildings and facilities or (ii) debt service payments, or a portion thereof, for any such projects completed in the previous ten years if so designated. No disbursement from the fund may be made except upon specific appropriation by the governing body in accordance with applicable law. If a locality establishes such a fund and designates any portion of the funds deposited therein to pay debt service for (i) any general obligation of the locality held by the Virginia Public School Authority or (ii) any Literary Fund loan, the locality shall obtain an opinion of bond counsel that designation of funds to pay debt service on obligations described in clauses (i) and (ii) hereof does not adversely impact the tax-exempt status of such obligations.

C. All grant awards deposited in the fund, including all income from or attributable to such fund, shall be deemed public funds of the locality and shall be subject to all limitations upon deposit and investment provided by general law, including, but not limited to, the Virginia Security for Public Deposits Act (§2.2-4400 et seq.). Income, dividends, distributions, and grants accruing to the fund shall be retained in such fund and shall be expended only in accordance with the terms of this section.

D. Nothing in this section shall be deemed or construed to authorize a school board or school division to receive, hold or invest funds in its own name, nor to expend funds in the absence of a specific appropriation by the governing body of the locality in accordance with applicable law. “

The county intends to sign a letter of intent to sign the contract to build the Swamp School?  Again they violate their oath of office.  Is our county attorney trying to prove to us he is a full time County Jester and not a lawyer?  Or do they all have a total disregard for the laws of Virginia? Maybe we should let them sign the letter of intent violating the law and then let them pay for the building out of their personal funds?

I am not a lawyer and cannot give legal advice.  Our founding fathers used common sense and Christian scripture when establishing our founding documents.

Our Notes:  During the 17th and 18th century, the colonies, the world, dealt with pirates who swindled anything they could get their hands on.  Today, the pirates wear ties and suits and try to convince us that what they are doing is in the best interest of the children, the community, the state or the entire country.

Page Middle School News, Gloucester, VA

What we report is the news you were never told and what Gloucester Officials do not want you to see.  Why?  Because it opens a lot of questions as to what is going on in the county and we keep showing how county officials like to waste your tax dollars and could care less about the people they were asked to represent.  It seems like it's a private country club for the privileged where the rules are made up as they go along as long as it serves their interests, but not yours.

Here is more of what they would rather you never see.

*In April 2010 RRMM was awarded a professional services contract to provide services for the potential of repurposing Page Middle School into a school administration and operations center.

*In April 2011 Page was damaged by a tornado.

*In June 2011 a request for professional services was publicized.

*In July 2011 eleven proposals for professional services were received.

*On August 9, 2011 five options for rebuilding Page were presented by RRMM.  Option 1 was recommended (build a 6 thru 9 middle school on TC Walker Road property, demo old page with the exception of the gym and auditorium and build a new school administration and operations center.

*On August 25, 2011 the school board voted to approve option 1.

*In January 2012 RRMM was awarded the professional services contract to provide services to review the potential of reconstructing Page.

*In June 2012 Page was completely torn down.
 
Three questions:

1.         Why was the County paying RRMM for services after April 2011 without competitive sealed bidding or competitive negotiations for the services?

2.         Who is going to reimburse Gloucester tax payers for the gym and auditorium (both real property) that were to remain, but were torn down?

3.         What was going to happen with Page students when the old Page school was repurposed?

RESPONSE:

RRMM Architects provided services under an ‘open-to-buy’ contract for professional consulting services that was awarded to seven (7) firms, of which RRMM Architects was one of the providers.  These contracts were awarded under a formal competitive negotiation process that was advertised on October 30, 2009.  RRMM was awarded their contract for these consulting services on April 21, 2010.  RRMM Architects assisted with the damage assessment following the tornado and also facilitated the community group that proposed long-term solutions for the loss of Page Middle School.
 
Prior to the tornado, Page Middle School was considered as a possible location for centralized administrative services, but only after a new middle school was to be built in accordance with the School Board’s Capital Improvements Plan.

Now has anyone noticed that even though there was a response to the questions asked, the questions were never answered?  Never. The response did not touch any part of the questions.  You do this when you have issues to hide.  It's a very old game.  Now The Kiser is supposed to be an educated man with a Doctorates degree.  We find it very difficult to believe that he does not understand the questions.  For him to even state he did not understand the questions would prove to be very disturbing as he is in charge of the education of the county's children.  Intel coming in is getting more disturbing by the day.

Gloucester, VA Page Middles School Dis Service Announcement 3

Below is information direct from county records.  It shows what county citizens recommended to county officials in regards as to what to do about the Page Middle School.  As we all know, county officials have shown everyone in the county that they could care less what the input from the citizens are.  They are going to do what ever they want and were only going through the check marks of what they are required to do.

  No one wanted to see the new Page Middle School being built in the new swamp location.

Gloucester, VA Government Employees Monday Report

Our report for Monday morning of Gloucester, VA employees abuses and breaking local and state laws is running late this week as meetings and other media issues were forced on us to take a front seat in our attention.

  So here is Monday's report.  Gloucester, VA animal control vehicle ,pictured here to the left, was seen driving through the parking lot around the Big Lot's area of the shopping center looking for someone with a camera.  He kept going through the middle of the parking lot looking at all the various vehicles.  He obviously did not see me over at the 7-Eleven.  What was really funny about the entire matter?  Animal Control officers overlooked a woman in a gold Sebring Chrysler convertible with a German Sheppard, unsecured, in the vehicle, with the top down on the vehicle.  So what?  Well in any other case we would agree, except Gloucester has an ordinance that makes this a very clear violation and one we have already argued is not a valid ordinance and have asked to have it removed from the books.  The county has refused to remove it from the books and state that the ordinance is in accordance to state law.  Then why didn't they enforce it here?  Did they violate their oath to uphold county and state laws?  Or did they violate upholding an ordinance they know is a violation?

  Now what really concerns me is that his looking for me was personal and not business use of a government vehicle.  Animal Control personnel are obviously concerned with being caught violating the laws and want the reporting to stop.  How is this county business?


Our boy here, Mr Happy meals on wheels made his Monday morning appearance in the same shopping center for the same reason.  He did not stop for his morning happy meal.  He just drove through the lot looking for someone with a camera.  What is interesting to note, he was caught on both Monday morning last week and again on Friday morning last week and here this past Monday, he is still driving around using a county vehicle for his own personal use.  Officials have done nothing to stop employees from using county vehicles for personal use and even when it is reported to county officials, you still see these same people out continuing to do the same thing over and over and over again.

Only now county employees are looking for someone with a camera.  This is a very simple matter.  When county employees stop violating laws, we will stop taking pictures of them violating the laws.  If they start again, we will start again.  So the question remains.  Why can't county officials manage their employees?

October Gloucester, VA Ordinances In Violation of State Code

Sec. 3-14. Use of fireworks causing injury to animals.

It shall be unlawful to set off or use any fireworks that result in an injury to any animal caused by direct contact with the fireworks or if the animal injured itself from fear of the fireworks.

  Sounds like a decent ordinance.  If it could be enforced, it would be.  Problem is, it has no parallel in state code that we can find.  Also, we tested this and the county can not nor will not enforce it.  What they have done in the past is send out Sheriff's deputies to try and witness an event.  The deputies only stay so long and if they do not see anything themselves, there is nothing they say that they can do about it.

  In other times, officials have instead sought to attack those who reported the issues.  ???  No joke.  Dig through this site and you will eventually find confirmation on this.  (Clue, go back a few years and dig through posts after the 4th of July).    It's hard to argue against an ordinance that for all intents and purposes seems very logical and in the best interests of the people.  But when it has no basis in state code, it has no business being there in the county ordinances.   It's once again Gloucester officials making up their own nanny state rules at their own whim and pleasure which do not serve the common good of the people even if it appears to.

In less than one hour, the Gloucester Board of Supervisors meeting will begin.  At this meeting, they will only be addressing one ordinance in violation of state code while there are many that remain in violation of state code and they are aware of a number of these violations.  There are a lot of questions about these people voted in that we expected to represent us and instead have made it a choice to misrepresent us at so many levels.
