Gloucester, VA - Local Government Officials Don't Even Follow Their Own Laws?


http://library.municode.com/index.aspx?clientID=10843  This is a link to Gloucester, VA municode where local ordinances are listed for the entire county.  The specific link above is for required landscaping.  In the above picture, the white building to the left is the Gloucester County garage.  Why have they not followed their own ordinances in landscaping?

  We have county officials who drive county vehicles at taxpayer expense to run personal errands, officials who do not follow their own codes, officials who are involved in what appears to be serious conflicts of interest playing roles on multiple public boards, officials who initiate poor public sidewalk designs that hurt local businesses, officials that violate the Dillon Rule and make up their own ordinances as they go along, and these people want to raise your taxes to give each other raises?  It's not a democratic or republican party thing.  It's just county officials having a party at taxpayer expense.  They want to thank you for paying.

In this photo we have local businesses complying with local ordinances at a fairly hefty expense to the businesses.







In this photo we have PHA or Peninsula Heating and Air that looks like they are in violation of the ordinance.  In fact, the owner has been overheard bragging that he has no intention of ever complying as he thinks the ordinance is stupid.  Why are some businesses and the county allowed to not comply while others have to?

Gloucester, VA - Cuccinelli Rules Conflict Of Interest. Complaints Of Party Politics Unwarranted - Gloucester Next?

If you missed the article in the Daily Press on Sunday, Attorney General Ken Cuccinelli ruled against both the Mayor and the deputy mayor of Hampton on being on dual public boards.  In the state of Virginia, it is forbidden.

  The really nasty part of the article is the complaints coming from Hampton officials charging Cuccinelli of playing party politics. Like it's some sort of democratic vs republican fight.  It's very simple and very clear, it's against the law.  It has nothing to do with party politics.  These officials got off easy.  They should have been investigated for potential criminal activity and charged with any findings.  Being told that they must get off the board without going through any investigation was an easy sentence.

Then the city officials have a meeting to see who's brother or sister they can appoint to the positions on the board of trustees at Fort Monroe right after being told they are out.  What a joke.  It has to make you sick that these corrupt officials are continuing to play the same game anyway.

  We have the same exact issue here in Gloucester.  Louise Theberge is representing two public offices.  She is the chairperson for the Gloucester County Board of Supervisors and on the board of the Gloucester Main Street Preservation Trust.




http://mspt.org/about.html  Is the link to the above page.  On that page you will see that the trust also manages the Gloucester Main Street shopping center.  The shopping center is a tax paying entity to Gloucester County.  With Louise Theberge on the board of both entities, the issues of conflicts of interest are very real.  In fact let's examine one.

This is a very recent photo of Edge Hill Shopping Center.  Edge Hill had to install this island because of new ordinances that require locations with new permits to come into compliance with Gloucester's beautification initiatives.




Exactly where are the islands for the Gloucester Main Street Shopping Center?  They too have had new permits for offices at this location.  Why is it they have not had to install islands here?  Is it because the Gloucester Main Street Preservation Trust is exempt from the same local ordinances?

If the Gloucester Main Street Preservation Trust is exempt from the same laws everyone else has to follow, how is that?  With Louise Theberge being on both boards, a serious conflict of interest could very well be at play.

Kudos to Ken Cuccinelli on his recent decision.  Now maybe he can do the same for Gloucester.

Gloucester, VA - Resident Complaint On Animal Control Officer Using County Vehicle For Personal Use

Dear Sir:

I write to you today to provide information on a incident I observed this morning in Gloucester County.  I am providing you the information to publish and to forward to a competent law enforcement agency and Gloucester County.  Based on reports you have made in your blog I do not feel safe making a complaint directly to Gloucester County.  Please do not use my name in the story or reporting to Gloucester County.  I have no problem sharing my identity with the State Police outside the county.

“This morning while traveling north bound on Rt.17 south of the Court House I observed, at 0655 15 April 2013, a Gloucester County Animal Control Vehicle at the exit of Chesapeake Bank, branch office on north bound side of Rt. 17 just below the old Wal-Mart Store, the driver was in a short sleeve grey shirt with the Animal Control logo on the sleeve.  It appeared the driver had straight light brown hair.  Because of the cloudy skies and time of the morning it was hard to tell any other facial details of the person.  I turned at the light to the KFC/Hardees and went into the parking lot.  When I parked I noticed this same vehicle go around back of the old Wal-Mart building.  About ten minutes, I did not look at my watch, later I observed this same vehicle  turned into the Hardees parking lot and go to the drive in window; shortly after that the vehicle came around the building and went to the traffic light and turned north on Rt. 17.  I was not where I could get a look at the driver after the initial sighting, but there were no other observations of Gloucester County animal control vehicles in this time frame.   I was not where I could see where the vehicle went and would not attempt to follow  the vehicle.  I did not have a cell phone with a camera to take a picture of this event.  However, I have witnessed a Gloucester County animal control vehicle leaving the same Chesapeake Bank branch on other mornings but do not remember the exact time or dates.”

Questions I have are why is a county vehicle being used for personal business?  It also appears the person may have been on the clock while performing this personal business?  If the county is going to allow personnel to use vehicles and pay them for personal business why should we as tax payers give them a raise?  They should be fired along with county offices that allow this to happen!  I have never seen Gloucester County Deputies using county vehicles to perform personal business and they are allowed to take them home so they can respond to emergencies.  I have no issues with this practice.  Virginia State Police also do this.

Gloucester, VA - Free Gloucester Court House Circle Poster Download



We are giving away a copy of a poster we designed a few years back.  The picture is from one of the buildings in the historic courthouse circle.  We took this photo during one of the revolutionary war re enactments held in the area by the 7th Virginia regiment.  They made a perfect background for this picture.

Gloucester, VA _ Weather Backwards

Weather Backwards seems to be what we have had this past winter.  This spring so far is proving to be nearly as strange.  The picture of the rainbow was shot at Christmas Time.  Warm day when we had a thunderstorm.  After the storm we had this incredible rainbow.  Looked like we were in for another mild winter.

After the rainbow disappeared we had some unusual colors in the sky.  The picture here is what we shot after the rainbow dissipated.







The Sunday just before the following Easter Sunday we had this nice big snowstorm. It was so heavy on a lot of the trees that branches came down in many areas.  Normally you want the snow for Christmas and the rainbow for Easter.  Weather Backwards.




Here is another picture taken on yet another Sunday late afternoon.  This was a bit of an unusual rainbow in the sky that seemed to be created by something to the left of the sun.  Everyone was trying to figure out what the reflection was on the far left in this picture.  The rainbow was only lightly defined.

Strange days and strange skies.  At least they make for interesting pictures.

Gloucester, VA - Parking Issues Along Gloucester Main Street Village

Part of the complaints we have been hearing are some of the parking along the Gloucester Main Street Village area has issues with where the light poles have been embedded into the sidewalks, next to the street causing a potential problem for passengers of motor vehicles to get out or back into their vehicles.

With small children, one can quickly have their door dented as children have a habit of just flinging open a passenger door in a hurry to get out.  If you are transporting a handicapped person, you will probably want to avoid these particular parking spaces by any of the street lights if you need the room to open a passenger door fully.

So that it is clear, the spot we parked in was a legal parking spot and pre defined by the white cross T line.  The T line is at the left of the rear of the vehicle in this picture.  This is just another example of the poor design and implementation work done on the Gloucester Main Street Village area that makes shopping local a real hassle.  In regards as to who is responsible if you dent your vehicle door?  It's on you.  The county is not responsible for any damage whatsoever, however, you could be held responsible for damages to the light pole if you should seriously harm it.  No it's not a two way street on this issue.

Gloucester, VA - Main Street Village's 3 foot sidewalks. Federal ADA Violations?

We have had a number of people complain to us about the conditions of the sidewalks in the Gloucester Main Street Village area.  We went to the area and conducted an assessment of the area and these are the results we came up with..

 There are many area's on Main Street that are obstructed by light poles and signs.  This significantly cuts down the pedestrian traffic.  This is just one of the many areas of complaints we have heard.  We will be covering other areas throughout the week.  We checked the specs of what is required for sidewalks and we will go over them here in this article.

  Without the obstruction, the sidewalk is 5 feet which is fine for residential as long as it is NOT obstructed.   Once obstructions are installed, other guidelines come into play such as effective width of the walking path.  But here is the funny part.  There are no federal ADA regulations for the most part except for widths concerning wheelchairs and the minimum overall width and a few other areas.  Everything else are suggested guidelines.   The suggested guideline for the Main Street Village area should be much wider than most of it is.  But there are no legal violations that we found in any of the widths here.  Just major obstructions that hamper pedestrian traffic flow and are very annoying to walk over.

4.3.3 Width

The widths of sidewalks not only affect pedestrian usability but also determine the types of access and other pedestrian elements that can be installed. For example, a 1.525-m (60-in) sidewalk is probably wide enough to accommodate pedestrian traffic in a residential area,but a much wider sidewalk would be necessary to include amenities such as street furniture or newspaper stands.Design width is defined as the width specification the sidewalk was intended to meet; it extends from the curb or planting strip to any buildings or landscaping that form the opposite borders of the sidewalk  .Minimum clearance width is defined as the narrowest point on a sidewalk. An inaccessible minimum clearance width is created when obstacles such as utility poles protrude into the sidewalk and reduce the design width.A reduction in the design width could also create a minimum clearance width.

Although most guidelines require sidewalk design widths to be at least 1.525 m (60 in) wide, larger design widths can accommodate more pedestrians and improve ease of access. The AASHTO Green Book, the Oregon Department of Transportation guidebook, and other guidelines recommend wider design widths in areas with high volumes of pedestrians. The sidewalk width often depends on the type of street. In general,residential streets have narrower sidewalks than commercial streets.
The guidelines and recommendations that were reviewed for minimum clearance width are included in Tables 4-2.1 through 4-2.4 at the end of this chapter. Most of the guidelines reviewed concur with ADAAG, which specifies that the minimum passage width for wheelchairs should be 0.815 m (32 in) at a point and 0.915 m (36 in) continuously (ADAAG, U.S. Access Board, 1991). Additional width is necessary for turning and maneuvering.

The width of the sidewalk is also affected by pedestrian travel tendencies.Pedestrians tend to travel in the center of sidewalks to separate themselves from the rush of traffic and avoid street furniture, vertical obstructions, and other pedestrians entering and exiting buildings. Pedestrians avoid the edge of the sidewalk close to the street because it often contains utility poles, bus shelters,parking meters, sign poles, and other street furniture. Pedestrians also avoid traveling in the 0.610 m (24 in) of the sidewalk close to buildings to avoid retaining walls, street furniture, and fences (OR DOT, 1995). The sidewalk area that pedestrians tend to avoid is referred to as the shy distance. Taking into account the shy distance, only the center 1.830 m (6 ft) of a 3.050-m (10-ft) sidewalk is used by pedestrians for travel, as shown in Figure 4-7. Thus,the effective width of a sidewalk, not the design width, constitutes the sidewalk area needed to accommodate anticipated levels of pedestrian traffic.

In this picture, you see a double obstruction to the pedestrian path lowering the sidewalk usability even more than our first picture.  This section is less than 32 inches, however, the obstructions are not next to each other even though they create highly limited access.




In this picture, you have an area again less than 5 feet, with a clearance of about 37  inches.  It may meet the law for a wheelchair, but it misses the intention of the laws.  At least a person in a wheelchair can invade someone's driveway and lawn to get through here.




 This is the area where we were going to take a wheelchair but then decided that blocking pedestrian traffic in an already limited area would not be a good idea.  The clearance is about 38 inches.  Again, it may meet federal ADA law per se,. but it's a potential elbow buster and is one of two obstructions within a very short distance against this wall.

This is the other obstruction along that same wall as shown above.  The clearance here is 39 inches of usable pedestrian traffic to include a wheelchair.  Average overall wheelchairs are between 24 inches wide to 34 inches wide.  If you are in one of the wide wheelchairs and are self propelled, your arms extend out past the wheel width.  38 inches will be very uncomfortable to try and maneuver through but not at all impossible.  It might prove to be very nerve wracking for some however.

   "An inaccessible minimum clearance width is created when obstacles such as utility poles protrude into the sidewalk and reduce the design width."  Now this is pulled from the federal ADA guidelines.  As we have shown, there are multiple areas at the Gloucester Main Street business district that are below 3 feet. due to obstructions in the walkway.

  ",the effective width of a sidewalk, not the design width, constitutes the sidewalk area needed to accommodate anticipated levels of pedestrian traffic."  So the constant obstacles of light poles, street signs, newspaper boxes, embedded or on the sidewalk throughout the area lower the effective width of the sidewalks. 

  The design width before obstructions meet the bare minimum width requirement of 5 feet wide for a residential area.  But once again, we are supposed to be talking about a business district.  This, in our view, is anti business.  It says to people that we do not want you walking around here.  Why else make accessibility so poor?  It also says that we are not expecting anyone to really walk around and shop here as well.  Great way to attract future business into the area.

This section of Gloucester Main Street seems to be the only area where the sidewalks are done correctly.  The effective pedestrian area is ample for a good amount of foot traffic.  We are only talking about a couple of blocks on one side of the road that looks like this however.


Here is a measurement along the sidewalks of Heron Cove, just off of Gloucester Main Street.  It's 6 feet wide with no obstructions in the walkway whatsoever.





This is a longer view of the sidewalk in Heron Cove.  Again, no obstructions in the walkway.  Amazing how they can get it right and this is a residential area off of Main Street.





Now as seen above, if you are going to install street furniture, (Light Poles, Signs, etc), it is recommended that you increase the usable part of the sidewalk.  Something Gloucester Officials decided not to do?  In fact, the recommendations are for planners to factor in decreasing the size of the roads to increase the size of the sidewalks.  Didn't we see the opposite here?  The road size was increased and the sidewalks decreased?  So again, we do not need more bad planning.

In this picture, you see multiple obstructions along the sidewalk.  This affects pedestrian traffic flow.  The cross grade along here is also uncomfortable for many handicapped people.   There is questionable debate if the cross sloping of this section of the sidewalk actually slopes to much which could be of danger to pedestrians in wheelchairs of using canes or crutches.  This requires special measurements which we were not prepared to do at this time.

  Guess this is the price we are expected to pay for beautification?  Forget accessibility, appearance is much more important.
