"The Land of the Life Worth Living?" 

The Virginia Constitution was written for us to limit the government intrusion into our lives.  Have you ever read the Constitution of the United States?  How about the Constitution of Virginia?

Listening to the Sheriff speak during the Board of Supervisors meeting last week.  Sheriff Warren said when asked about escorting the judges that they only have one shift per day and it would require overtime to escort judges to their cars.  If the sheriff’s office is only operating one shift per day who is keeping us safe when they are not on duty? Does this explain the crimes at night?  Why do we see sheriff’s vehicles on the road and at local businesses all hours day and night?  Is this for personal errands?  When is a good time to call to ensure we will get a response or someone will answer the phone?

Maybe we should consider doing away with the Sheriff’s Department and getting a professional Police Force?  One that is there to ensure the rule of law is obeyed and enforced; not an organization that serves at the Sheriff’s convenience? This would help to make it "The Land of the Life Worth Living?"

"The Land of the Life Worth Living?"  Not if you continue to have a total disregard for the law and the people of Gloucester County.  I watched the BoS meeting last week and the Board continues to show a total disregard for the Rule of Law and the people in the county.

The Virginia Constitution was written for us to limit the government intrusion into our lives.  Have you ever read the Constitution of the United States?  How about the Constitution of Virginia?You know when Ted the Court Jester, County Attorney read the proposed replacement ordinance did you not see his pants on fire? Or his nose growing?  When he adds words that are not in the Code of Virginia that means it is not in compliance with Virginia Law we know this.  Mr. Wilmot does not do a good job talking when he is not telling the truth, why do you keep making him lie for the County?  Or are you not smart enough to know he is not telling the truth?  You need to put the muzzle back on the County Jester.  He did not help your cause during the meeting!

Changing the Ordinance and getting the citizens of Gloucester to pay for guns for retiring Animal Control? Where in the Code of Virginia is this allowed since they are not law enforcement!  Let them buy their own guns!  Let retiring Deputies buy their own guns also if they retire and not meet the requirements of Virginia Code.  Also raising the taxes of the citizens to give the judges anything they want? Watch the meeting on Mr. Thompson’s blog and see this. You do think our money belongs to the County?  I was glad to see some backbone being shown but this contempt for the rule of law needs to stop. 

Is this board trying to go out as the most corrupt Board in the History of the County?  What a legacy you leave.  You do not deserve to be recognized for your service.  You may have started out with good intentions, and we all know the road to hell is paved with good intentions, but you have gone downhill from there.

Gloucester Schools are Constitutional?

Did you get a chance to go to the candidates for the School Board and Board of Supervisors?  I did not however, Mr. Thompson has it on his blog for you to enjoy.  I found it interesting one of the School Board Candidates and a local lawyer Ms. Hook said our schools are constitutional.

The Virginia Constitution was written for us to limit the government intrusion into our lives.  Have you ever read the Constitution of the United States?  How about the Constitution of Virginia?

Article VIII (8) Education in the Virginia Constitution covers this. 

“Section 1. Public schools of high quality to be maintained.

The General Assembly shall provide for a system of free public elementary and secondary schools for all children of school age throughout the Commonwealth, and shall seek to ensure that an educational program of high quality is established and continually maintained.”

Looking at Section 1 we will have free public schools provided by the General Assembly.  Are the schools free? Do you have to pay fees for your children to go to school? Makes me wonder what they are doing with the funding provided by the General Assembly?

“Section 2.  Standards of quality; State and local support of public schools…..   ….The General Assembly shall determine the manner in which funds are to be provided for the cost of maintaining an educational program meeting the prescribed standards of quality, and shall provide for the apportionment of the cost of such program between the Commonwealth and the local units of government comprising such school divisions. Each unit of local government shall provide its portion of such cost by local taxes or from other available funds.”

Looking at Section 2 I see why we have to pay “….funds are to be provided for the cost of maintaining an educational program meeting the prescribed standards of quality….” Maybe if our school met the required standards we would not have to pay.

As county residents we need to let the school board know we expect the schools to meet the prescribed standards.  If the staff is not capable we need to get rid of them and replace them with people that can meet the standards.  Is the Kiser too busy looking to make a name for himself with the new swamp school and working on the final solution for our youth that he does not have time to worry about meeting standards?  This needs to stop. Meet the standards or get out.  This violates your oath of office wanting a .brass plaque with your likeness and name rather than meeting school standards.  Are you too busy wheeling and dealing to get the swamp school you cannot meet the obligations of your contract?

Gloucester County, the Battle of the Hook, and Local Government

The Battle of the Hook reenactment that took place last weekend was a very good event put on by the county and it shows the effort that went into making this event happen. Thanks to everyone.

With that said now to the focus of this letter.  Ms. Theberge was overhead during the Saturday evening reenactment saying she did not understand what the people on the field were doing.  She repeated this several times.

The Virginia Constitution was written for us to limit the government intrusion into our lives.  Have you ever read the Constitution of the United States?  How about the Constitution of Virginia?

With Ms Theberge not being a student of war or the American Revolution that makes sense that she did not understand that the artillery was there to protect the attacking troops and would not go forward during the final push on the redoubt.  However, I believe the County officials do not understand what the war was fought to accomplish.  The County officials, acting like the ruling elite from the 1700s, do not listen to the citizens of the county and do what they want and raising taxes to pay for their wants.  Passing ordinances that are not in accordance with Virginia Code. Building swamp schools rather than repairing functional buildings.  If you visited the Battle of the Hook you would have seen Ms Theberge in her Royal Chariot going around the grounds looking down her nose at us common people on Saturday.  The Royal Guard was there in their full battle armor intimidating the people there enjoying the events going on around them.

Our elected county officials need to represent all of the people not just a few that are their friends.  We need to let the Board of supervisors know that if they are not going to represent all of the people they will be replaced.

Since County officials are incapable of following the law as shown repeatedly on this blog site; do they think that signing a letter of intent to sign the Contract for the Swamp School is legal before the funding is available?

Code of Virginia

Ҥ 15.2-1238. Certification of sufficient funds.

Except in emergency, no order for delivery on a contract or open market order for supplies or contractual services for any county department or agency shall be awarded until the chief financial officer has certified that the unencumbered balance in the appropriation concerned, in excess of all unpaid obligations, is sufficient to defray the cost of such order.

15.2-1239. Orders and contracts in violation of article.

If any department or agency of the county government purchases or contracts for any supplies or contractual services contrary to the provisions of this article or the rules and regulations made there under  such order or contract shall be void and the head of such department or agency shall be personally liable for the costs of such order or contract.

§ 22.1-175.5. Capital School Projects Fund.

A. The governing body of any locality which is awarded a grant pursuant to this chapter may authorize the local treasurer or fiscal officer, by ordinance or resolution, to create a separate escrow account upon the books of the locality, as described in this section. Upon the adoption of such ordinance or resolution, the treasurer of the locality shall place such grant awards into this account.

B. The escrow account shall be known as the "County/City/Town of ____________ Capital School Projects Fund." All principal deposited to such fund, together with all income from or attributable to the fund, shall be used solely for (i) construction, additions, renovations, including retrofitting and enlarging public school buildings, infrastructure, including technology infrastructure, and site acquisition for public school buildings and facilities or (ii) debt service payments, or a portion thereof, for any such projects completed in the previous ten years if so designated. No disbursement from the fund may be made except upon specific appropriation by the governing body in accordance with applicable law. If a locality establishes such a fund and designates any portion of the funds deposited therein to pay debt service for (i) any general obligation of the locality held by the Virginia Public School Authority or (ii) any Literary Fund loan, the locality shall obtain an opinion of bond counsel that designation of funds to pay debt service on obligations described in clauses (i) and (ii) hereof does not adversely impact the tax-exempt status of such obligations.

C. All grant awards deposited in the fund, including all income from or attributable to such fund, shall be deemed public funds of the locality and shall be subject to all limitations upon deposit and investment provided by general law, including, but not limited to, the Virginia Security for Public Deposits Act (§2.2-4400 et seq.). Income, dividends, distributions, and grants accruing to the fund shall be retained in such fund and shall be expended only in accordance with the terms of this section.

D. Nothing in this section shall be deemed or construed to authorize a school board or school division to receive, hold or invest funds in its own name, nor to expend funds in the absence of a specific appropriation by the governing body of the locality in accordance with applicable law. “

The county intends to sign a letter of intent to sign the contract to build the Swamp School?  Again they violate their oath of office.  Is our county attorney trying to prove to us he is a full time County Jester and not a lawyer?  Or do they all have a total disregard for the laws of Virginia? Maybe we should let them sign the letter of intent violating the law and then let them pay for the building out of their personal funds?

Speaking for the taxpayers in Gloucester County; we want the Board of Supervisors to answer these questions.  Why are we paying full time salaries for part time staff?

Why are we paying for a County Attorney that you have made into a Court Jester? Granted he is entertaining and quite a site but that is a lot of money to spend for 2 hours of entertainment a month and you did not let him perform during the last Board of Supervisors meeting.  I was disappointed.  Although Brenda was not a bad stand in as County Jester in the last meeting and if you keep getting her to answer for the County Attorney in the meetings in a month or two we will vote for her as our favorite Jester, she still needs a little more practice.  Can she juggle or get a better script about a subject she knows something about?

Also, we are paying for a full time County Administrator and you are not allowing her to do this? Or does she want to be the County Attorney or County Jester we are not sure which based on her performance at the last meeting?  Is she qualified to be our County Attorney?  She still needs work to take over as County Jester, in my opinion.  Maybe we should let her run the County and get the employees back on the job and out of the fast food establishments unless they are picking up food for her and The "Kiser".

Speaking of The "Kiser", you pay for him even if the School Board made this selection.  His final solution for our youth in the design and placement of the new swamp school does not appear to have the education, safety, and interest of our youth as the primary goal in this new school?  We have several members of the Board that claim to have interest in our schools and youth, it does not appear this is the case to some tax payers.  It appears that you have developed a final solution that is more fitting as the end of our youth rather than the education of our youth.  You have forgotten the most important part of the new swamp school; you need to have a huge bronze plaque with The "Kiser’s" likeness, his name, along with the name of all the school board, and board of supervisors that are responsible for this facility.  Do not place it too close to the school we do not want it to sink into the swamp with the school.  We want to remember all of the people responsible for bring us this swamp school.

Based on the continued actions or inaction's of this Board it appears you have a total contempt for the tax payers, Virginia Constitution, Virginia Code, the US Constitution and oath of office.

Bring back the rule of legal laws and make this "The Land of the Life Worth Living" for everyone in the county.
