Gloucester, VA - What The Main Street Preservation Trust Wants To Waste Your Money On

We just looked over the PDF on the Gloucester Main Street Preservation Trust site.  You need to see what they want to waste your money on.  It's not all bad, but it's a lot of garbage in many of the suggestions.  We did some brainstorming ourselves to see is we could come up with a plan that makes sense for Gloucester Businesses.  Yes we are aware that our recent posts have not been flattering to the business district.  We are not picking on the businesses though.  We are picking on the areas that are anti business to the local business owners.

  What do we propose that we think would be better?  Glad you asked.

Get rid of all on street parking along the Gloucester Main Street Business District.  Gloucester County would need to expand and open a viable parking lot along or around the historic circle at about where the county offices are presently located. That would be parking area 2.  Parking area 1 would be at the Gloucester Main Street Center.  Widen the sidewalks along the business district to actual usable walkways.  If the Gloucester Main Street Preservation Trust and the Gloucester Main Street Association are really serious about promoting business and businesses in the area, let them invest in trolleybuses to move people around the business district at regular intervals free of charge and not at taxpayer expense.

   As long as businesses are open, the trolleybuses are running.  This is a simple plan that would expand business in the area.  Who would not want to shop in an area that is like a vacation destination?  You could actually have businesses lined up waiting to come into the area if you build something along these lines.  It works very well across the river in Yorktown.  But you have to believe that both Gloucester County government along with the Gloucester County Triad have the best interests of businesses in mind or if they are just paying lip service to the idea.

It's Now Official, TC Walker School Is Closing

As of last night, Tuesday, March 13th, 2012 in an official Gloucester County meeting, it was determined that TC Walker school will be closing it's doors as a school for good. A few things to keep in mind when trying to reason why the county would act in this manner. One. When dealing in a government setting, one is judged for success by the budget one controls, not how much money one makes or how much money one saves. Government is not in the business of making a profit nor is it in the business of saving money on anything. Therefore, what makes business sense to anyone outside of government does not make any sense to anyone inside of government. It then makes sense to do what is going to create the highest level budget you can control than to determine what makes sense for those you have been elected to serve.

What all of this means is we are headed for higher taxes. A natural disaster is great for politicians as it always raises the budgets of someone somewhere. As your budget goes up, so does your value and your pay. With the higher pay, you can now afford the extra taxes you helped bring about. But do not look at it as having to pay higher taxes for the increased budgets our officials burden us with. Think of it as increasing the value of the resumes of our elected officials instead. Yeah, that should help you sleep better at night now.

So what is the county going to do with the empty school? The inside track says that they are already looking at the property as additional office space. Expanding government with higher costs and higher budgets meaning higher taxes. Wait, I mean value added resumes for those in charge.



What I would like to see is the county turn one of it's buildings into a homeless shelter. The county has ignored this problem way to long. What the county does with the homeless of this area other than ignore them is to send them instead to places like the homeless shelters over in Newport News and Hampton that are already way over burdened. Just last night I was communicating with a family via email that has a serious homeless problem through no fault of their own. They were residents of Gloucester and have a long history here. They have been forced across the river because Gloucester does nothing about these issues. By the way, that ploy is over 100 years old and is very effective at shifting the burden from one area to another.

The recent figures here in Gloucester is that we have 54 babies that are presently homeless. The overall figures of actual homeless in Gloucester are staggering with nothing being done about it. These are not your normal hopeless drunks or junkies either. These are hard working people that lost their jobs and then their homes. People when you look at them and talk to them, you would never know their issues. I know of one reverend who has been doing everything he can to try and help but has been getting almost no help from anyone anywhere. When we have approached churches, organizations and local government, they all have the same answer, we have no answer nor do we plan on putting anything together any time soon. Well here is a great way to put together a new budget and expand local government and create new jobs helping people who have been victimized by the new economy.

Moody’s To Downgrade US If No Deal To Cut Debt/GDP Ratio

WASHINGTON (MNI) – The following is the text of a statement Tuesday
by rating agency Moody’s:
Budget negotiations during the 2013 Congressional legislative
session will likely determine the direction of the US government’s Aaa
rating and negative outlook, says Moody’s Investors Service in the
report “Update of the Outlook for the US Government Debt Rating.”
If those negotiations lead to specific policies that produce a
stabilization and then downward trend in the ratio of federal debt to
GDP over the medium term, the rating will likely be affirmed and the
outlook returned to stable, says Moody’s.
If those negotiations fail to produce such policies, however,
Moody’s would expect to lower the rating, probably to Aa1.

Moody’s views the maintenance of the Aaa with a negative outlook
into 2014 as unlikely. The only scenario that would likely lead to its
temporary maintenance would be if the method adopted to achieve debt
stabilization involved a large, immediate fiscal shocksuch as would
occur if the so-called “fiscal cliff” actually materializedwhich could
lead to instability. Moody’s would then need evidence that the economy
could rebound from the shock before it would consider returning to a
stable outlook.
Moody’s notes that it is difficult to predict when during 2013
Congress will conclude negotiations that result in a budget package. The
Aaa rating, with its negative outlook, is likely to be maintained until
the outcome of those negotiations becomes clear.

Will Science Someday Rule Out the Possibility of God?

Over the past few centuries, science can be said to have gradually chipped away at the traditional grounds for believing in God. Much of what once seemed mysterious — the existence of humanity, the life-bearing perfection of Earth, the workings of the universe — can now be explained by biology, astronomy, physics and other domains of science. 
Although cosmic mysteries remain, Sean Carroll, a theoretical cosmologist at the California Institute ofTechnology, says there's good reason to think science will ultimately arrive at a complete understanding of the universe that leaves no grounds for God whatsoever.
Carroll argues that God's sphere of influence has shrunk drastically in modern times, as physics and cosmology have expanded in their ability to explain the origin and evolution of the universe. "As we learn more about the universe, there's less and less need to look outside it for help," he told Life's Little Mysteries.
He thinks the sphere of supernatural influence will eventually shrink to nil. But could science really eventually explain everything?

Gobs of evidence have been collected in favor of the Big Bang model of cosmology, or the notion that the universe expanded from a hot, infinitely dense state to its current cooler, more expansive state over the course of 13.7 billion years. Cosmologists can model what happened from 10^-43 seconds after the Big Bang until now, but the split-second before that remains murky. Some theologians have tried to equate the moment of the Big Bang with the description of the creation of the world found in the Bible and other religious texts; they argue that something — i.e., God — must have initiated the explosive 
event.

However, in Carroll's opinion, progress in cosmology will eventually eliminate any any perceived need for a Big Bang trigger-puller.
As he explained in a recent article in the "Blackwell Companion to Science and Christianity" (Wiley-Blackwell, 2012), a foremost goal of modern physics is to formulate a workingtheory that describes the entire universe, from subatomic to astronomical scales, within a single framework. Such a theory, called "quantum gravity," will necessarily account for what happened at the moment of the Big Bang. Some versions of quantum gravity theory that have been proposed by cosmologists predict that the Big Bang, rather than being the starting point of time, was just "a transitional stage in an eternal universe," in Carroll's words. For example, one model holds that the universe acts like a balloon that inflates and deflates over and over under its own steam. If, in fact, time had no beginning, this shuts the book on Genesis. If you start to dig through Youtube videos, there is enough evidence there to support the Bible.  Giants often referred to as the Nephilim are mentioned in the book of Genesis.  The evidence of giant bones be uncovered is held out of the mass media.  Again, where does truth start and disinformation start?

Animal Control Code, Law, Ordinance, Section 3-15, Wrongfully Charged? Gloucester, VA

We are going to open this post with the statement; We are not attorney's and the following information does not constitute legal advice.  Only an attorney can give you legal advice.  The purpose of this article is to openly discuss issues we have found with Gloucester County Ordinance 3-15 as it presently exists as of January 18th, 2013 on the Gloucester County, Virginia site.

  If you have been charged and or convicted under Gloucester County Animal Control Ordinance Section 3-15, you may want to seriously consider getting legal advice as soon as possible.  We would suggest finding a competent attorney that is not, I repeat, not practicing in Gloucester County.  You will learn soon why we are making this suggestion.

  In December, 2012 we started arguing the legality of Gloucester County Animal Control Ordinance section 3-15.  We started looking at the ordinance from every standpoint as we felt that there was something seriously wrong with it.  Looks like we were right.  We will cover all of that in this article.  In our opinion, this ordinance is the most abused code in Gloucester County, designed to bypass and overstep state laws causing serious misuse, malicious abuse, and serious charges and or convictions on a section of the population of Gloucester County citizens in a serious violation of the public trust.

Here is the Gloucester County Animal Control Code section 3-15 as it presently stands;
                                                                                                                                                                          


Sec. 3-15.  Failure to perform duties of ownership; penalty.
(a)       Each owner or custodian of an animal shall provide for each of his animals all the following as defined in section 3.2-6500 of the Code of Virginia:
(1)       Adequate feed;
(2)       Adequate water;
(3)       Adequate shelter that is properly cleaned and sanitized;
(4)       Adequate space in the primary enclosure for the particular type of animal depending upon its age, size, species, and weight;
(5)       Adequate exercise;
(6)       Adequate care, treatment and transportation; and
(7)       Veterinary care when needed for disease control or to prevent suffering or disease transmission.
The provisions of this section shall apply to an owner or custodian of any animal, fowl, or reptile, including every private owner, animal shelter, pound, dealer, pet shop, exhibitor, kennel, groomer, and boarding establishment. This section shall not require that animals used as food for other animals be euthanized.
(b)       Game and wildlife species shall be cared for in accordance with current regulations promulgated by the Virginia Department of Games and Inland Fisheries.
            (c)        Violation of this section is a Class 4 misdemeanor.
                                                                                                                                                                                                                                   

This is still on the Gloucester County government web site under Animal Control as of January 18th, 2013.  Here is what the state law reads that the ordinance is required to emulate.  The State Law is 3.2-6503

§ 3.2-6503. Care of companion animals by owner; penalty.

A. Each owner shall provide for each of his companion animals:

1. Adequate feed;

2. Adequate water;

3. Adequate shelter that is properly cleaned;

4. Adequate space in the primary enclosure for the particular type of animal depending upon its age, size, species, and weight;

5. Adequate exercise;

6. Adequate care, treatment, and transportation; and

7. Veterinary care when needed to prevent suffering or disease transmission.

The provisions of this section shall also apply to every pound, animal shelter, or other releasing agency, and every foster care provider, dealer, pet shop, exhibitor, kennel, groomer, and boarding establishment. This section shall not require that animals used as food for other animals be euthanized.

B. Violation of this section is a Class 4 misdemeanor. A second or subsequent violation of subdivision A 1, A 2, A 3, or A 7 is a Class 2 misdemeanor and a second or subsequent violation of subdivision A 4, A 5, or A 6 is a Class 3 misdemeanor.
                                                                                                                                                                         

Note the major differences between the two.  Under 3-15, 3.) Gloucester added the term sanitized.  Not found in state law. under the corresponding section.  Under provisions highlighted on both 3-15 and 3.2-6503 above, there are again major discrepancies.  Gloucester uses the term all animals that is not found in state law.  That means if you have an elephant, Gloucester considers it to be a domestic pet?  Really?  It falls under 3-15 so yes it does appear that way.
  Also, Gloucester is saying that agricultural animals, fowl and reptiles are also considered the same as domestic pets. Again, this is all well above the state law.  The state of Virginia from what we know, does not allow any locality to create ordinances that are broader than state law.   The ordinance must emulate the state law.  Does anyone see an emulation here?  At first glance maybe, but upon inspection, not that we see.  So what happens when a county ordinance is above and beyond it's scope with state law?  It becomes a non law or null and void from what we understand.  
Here is what state law says about county ordinances.
                                                                                                                                                                                                                          
§ 3.2-6543. Governing body of any locality may adopt certain ordinances.

A. The governing body of any locality of the Commonwealth may adopt, and make more stringent, ordinances that parallel §§ 3.2-6521 through 3.2-65393.2-6546 through 3.2-65553.2-65623.2-65693.2-65703.2-6574 through 3.2-6580, and 3.2-6585 through 3.2-6590. Any town may choose to adopt by reference any ordinance of the surrounding county adopted under this section to be applied within its town limits, in lieu of adopting an ordinance of its own.

Any funds collected pursuant to the enforcement of ordinances adopted pursuant to the provisions of this section may be used for the purpose of defraying the costs of local animal control, including efforts to promote sterilization of cats and dogs.

B. Any locality may, by ordinance, establish uniform schedules of civil penalties for violations of specific provisions of ordinances adopted pursuant to this section. Civil penalties may not be imposed for violations of ordinances that parallel §3.2-6570. Designation of a particular violation for a civil penalty shall be in lieu of criminal sanctions and preclude prosecution of such violation as a criminal misdemeanor. The schedule for civil penalties shall be uniform for each type of specified violation and the penalty for any one violation shall not be more than $150. Imposition of civil penalties shall not preclude an action for injunctive, declaratory or other equitable relief. Moneys raised pursuant to this subsection shall be placed in the locality's general fund.
An animal control officer or law-enforcement officer may issue a summons for a violation. Any person summoned or issued a ticket for a scheduled violation may make an appearance in person or in writing by mail to the department of finance or the treasurer of the locality issuing the summons or ticket prior to the date fixed for trial in court. Any person so appearing may enter a waiver of trial, admit liability, and pay the civil penalty established for the offense charged.

  The above section shows what a locality may adopt, and make more stringent.  Not what a locality may adopt, and make broader terms for.  Ted Wilmot proposed changes to the local ordinances here in 2013 to reflect Animal Control law changes made by the state of Virginia back in 2011.  Are we a little behind here? So what that suggests is that Ted Wilmot has opened the county up to the potential of lawsuits for failing to maintain proper county ordinances?   3-15 of Gloucester County Animal Control is presently in violation of state law as we see it.  How many people have been charged with and or convicted of a violation to county ordinance 3-15 that in itself looks like it's a violation of state law?  So people have misdemeanor convictions against them based on an ordinance that itself was in violation of state laws?  This is what you bring to your attorney.

  The potential for a class action lawsuit against the county here is incredible as well as all the individual lawsuits from what we are looking at.  You can view the new proposed changes to section 3-15 on the following embedded PDF.





This is just one of 26 summons filed against one family here in Gloucester, VA.  20 of those charges were filed under Gloucester County Ordinance 3-15.  Ted Wilmot prosecuted this case knowing that the county ordinance was in violation of state law in our view.  19 charges under 3-15 were dropped but one was still charged and convicted putting a misdemeanor charge, fine and court costs against a person here in Gloucester.  The court allowed the charge and conviction proving to be a potential problem and not a potential solution.  So potential lawsuits against the county can not take place in the county.

  The funny part about all of this, in December, the Gloucester Mathews Gazette Journal reported that Gloucester Animal Control served 32 summons during the month of November.  What the paper did not tell you was that 26 of the summons were to only one family that Animal Control Officers pretty much destroyed  in our view.  See our story on this through this internal link.  http://www.gloucestercounty-va.com/2012/12/gloucester-va-animal-control-section-3_11.html

  It is in our opinion that the county may want to start looking at all the cases filed in court under 3-15 and consider reversing all the misdemeanor charges, fines and court costs.  Where should the money come from for all of this?  The Animal Control Budget of course.  Strip the county down to one Animal Control officer with no secretary.  Oldest out first as that is where the highest payroll is.  Keep the newest person as they have not jumped the pay grade yet, so the budget can be kept in line.  Replace Ted Wilmot with a new attorney with a lower pay grade that won't leave the county open on areas like this.

Again, we are not attorney's and this is not legal advice.  Only an attorney can legally advice you.  We recommend seeking legal advice if you or someone you know has been a victim of Gloucester County Ordinance 3-15.  We do not recommend attorney's from Gloucester as we are not aware of any that have argued the legality of 3-15 making any of them a potential part of the problem and not a part of the potential solution, but keep in mind not every attorney in Gloucester has had to defend clients against this code.  So it's a personal judgement call.  Also, not being attorney's we are not able to foresee all the issues that surround this controversy.

Gloucester County Case Update - Sgt Paul Emanuele

To date we have two highly questionable audio files provided by the county and used in a Gloucester County Court.  We have a 911 Dispatcher's testimony that does not match up to the 911 call.  We have an Animal Control officer who has testified that his audio recording, DW_C0152 is a true and accurate account of the days events yet as we continue to look real close at it, we just do not see how that could begin to be possible.  We have only grazed the evidence of Deputy Sheriff Sgt Paul Emanuele and this is where we are going to pick up today.

  If you have been following this story, below is a four minute and thirty second audio, made by Steve Baranek of Animal Control.  On the audio you hear Steve say that Paul Emanuele has just been made Sergeant.  What it takes to make it to that rank is very tough and you have to be a real sharp individual.  You not only have to qualify for the position, you also have to take and pass tests for the position.  It's not something that's just handed to someone.  So it would only be fair to give credit where credit is due.  We say that it is a very fair evaluation that Sgt Paul Emanuele is a very sharp person.

So let's again revisit his incident report for the events of May 4th, 2010 along with his involvement.


Now let's look at Sgt Paul Emanuele's statement above.  He was at the victim's address assisting numerous Animal Control Officers with a search warrant.  Let me repeat this.  Sgt Paul Emanuele was assisting Animal Control with a search warrant.  Okay.  I'll buy that for now.  Keep in mind, Sgt Paul Emanuele is a very sharp guy.



Now right above is Virginia law showing who has the power to do what.  Only a Sheriff, Deputy Sheriff or a Police Officer has the power to conduct the search.  Not Animal Control.  Looking above again at Sgt Paul Emanuele's own report, he was dispatched to this location and did not have previous orders to be there to serve a search warrant.  His own statement is that he was there to assist Animal Control, not head the search according to Virginia Law.  Is Gloucester County really going to try and argue that Sgt Emanuele made a mistake on his report?  Remember, this guy just made Sargent so you know he is very sharp. We believe this is Proof once again that there was no search warrant in place at the time both Animal Control Officers were there and the Gloucester County Sheriff's office was there.  (We now know by what Gloucester County sent us, there was no valid search warrant at that time).

  In our opinion, Sgt Paul Emanuele got caught up and sent into the middle of something very nasty.  He was doing the best he could in trying to produce something that matched the official story that the powers in Gloucester wanted told, and at the same time keep himself out of the middle of it all.  He has had to walk a very thin tight rope.  You have to feel sorry for this guy.

Gloucester, VA Filing Complaints, Animal Control Officers, County Attorney, More

Ever wonder what it would take to file a complaint against a county employee such as an Animal Control officer when they are abusive to you?  Were you even aware that you could?  We decided to see what it would take to file a complaint against someone when they are abusive and seeming to go above and beyond the scope of normal decency.  We started with Gloucester County's own Employment Personnel Policies and Procedures.  There we found that Gloucester County does not tolerate from any of it's employees the following, from 10-3 of it's own code, states this as one of many reasons for disciplinary measures.

  Use of offensive, abusive, threatening, coercive, indecent or discourteous language towards supervisors, other employees, or members of the public.

  This is what is publicly stated on the Gloucester County web site and found under Human Resources. A very common complaint we have heard over and over and over again is how abusive Animal Control Officers can be towards citizens of the county.  Animal Control Officers are Gloucester County Employees so this section applies to them as much as anyone else that is an employee of Gloucester County.

  Searching even further, we found no forms to use provided by the county that would show how to file a complaint against any county employee if and or when they violate county policies.  So we created our own based on Gloucester County Personnel Policies and Procedures.  All the information was there on what to do in order to file a complaint.  The complaint is supposed to become a permanent part of the employees employment records.

  Though our form is not an officially prescribed disciplinary form, Gloucester County does not have one that is officially prescribed that the public can use.  So our form is the next best thing in light of Gloucester County's failure to create one for public use.  10-3 has other areas of offenses as well.

  On our form, we have a section for a notary public to sign.  This is not required, however, it is highly recommended to create a more official complaint.  You can have a notary at your local bank take care of this section for you for free in most cases.  Do not sign the form until you are in front of the notary.

  The form is designed as a single person complaint.  If there are several people in your household or group that are filing a complaint, we recommend you use a form for each person.  If you are filing a complaint against more than one person, use a complaint form for each person.  The reason for this is because of where the form is filed against each person in their employee file.

  
  You may also wish to send us a copy of the complaint as well.  We are starting a database that can be searched by anyone to see if there are complaints already filed and what those complaints are.  This way nothing is hidden from the public.  If you wish to have your name removed from the bottom of the complaint, let us know when you send us a copy so that we can remove that from the database files.  Just send us a scanned jpg image of the form completed.

12 Busted In Drug Sting In Gloucester, Virginia - Spice and Bath Salts Found

GLOUCESTER — Twelve people were arrested Thursday in Gloucester and another suspect is being sought out of state following an investigation into the sales of synthetic drugs such as spice and bath salts.
Nearly 50 officers from various agencies participated in "Operation Direct Pressure" this morning in Gloucester, said Sheriff Darrell Warren.
Investigators were seen conducting searches at two shops in Gloucester. One shop on Route 17 in Hayes is called "Hazy Dayz" and the other shop on Route 14 in the Court House area is called "A Lil of This N A Lil of That."

    Warren said he was not able to comment on the identities of the people arrested or the precise charges pending their appearances in court. The suspects are expected to make their initial appearances in Gloucester County General District Court on Friday.



    12 people are behind bars Thursday night after police raided both “Hazy Dayz” and ”A Lil of This N That,” two Gloucester County businesses suspected of selling synthetic narcotics such as bath salts and spice.
    The arrests follow a lengthy investigation by several agencies, dubbed “Operation Direct Pressure,” aimed at combatting sales of the synthetic narcotics. Gloucester County Sheriff Darrell Warren says the investigation was conducted by members of the Tri-Rivers Drug Task Force comprised of narcotics investigators from the sheriff’s offices of Gloucester, York-Poquoson, Mathews, and Middlesex.
    Something Gloucester teen Iesha Cox says should have been done sooner. She says her friend was recently sent to the hospital after overdosing on spice.
    “It’s very upsetting because that could have been his life,” Cox says. “That could have taken his life away.”
    Megan Watkins has always lived in Gloucester. She says the culture of using the drugs has gotten out of hand.
    “It’s pretty bad,” she says. “I mean I’m in EMS. I’m volunteering and we get a lot of calls for you know spice and bath salts, stuff like that, so I’d say it’s a pretty large range of people who do it.”

    Now can the sheriff's office actually go after the real drugs and real drug dealers?  Anyone care to bet that these cases get thrown out because the ingredients in the spice and bath salts end up that they have not yet been banned in the state?  It makes for nice publicity anyway.
