Sunrise Donuts of Gloucester, VA - Multiple Health Code Violations? Hairy Donuts Anyone?

We created a PDF version of the Sunrise Donuts Facebook page.  The page is wide open to the public and anyone in the world can view it.  However, once they are aware of their own posts, they are sure to remove some very questionable pictures from their pages.  This PDF shows how the site looks with what we see as some potentially serious health code violations.

Hairy donuts anyone?

How many potential violations can you see here?  No hair net?  No food handlers gloves?  Paint Bucket for mixing dough?  Power drill used for a mixer?  Unsafe conditions as she is kneeling on a step ladder?  August 17th, 2013.  Note the commercial mixer in the background not being used.  Background sign also states only paid staff allowed in the kitchen.

In front of a deep fryer?  No hair net no food handlers gloves.












Is this a sign of a minor who has been drinking on the job?  Is this something that is allowed and possibly even a common practice at this shop?  From what we know, this girl is a minor.  Open beer bottles and liquor bottle in the Kitchen of Sunrise donuts?  What's in those donuts anyway.  Also, what is in the bag under her arm?  Big bag of marijuana?  Spice donuts anyone?  We have no idea what is in the bag, but the picture sure looks highly questionable.



Is this guy on the clock?  Did he pay for that donut?  Did he get more in that donut than he bargained for?  Is that a special spice donut?  Beer infused maybe?  This is their pictures.


















On another note, look at the logo at the top left hand side of the site, Sunrise Donuts and Sweets Shop at the top, Home of the "Crazy Chic" at the bottom.
From what we are seeing here on Sunrise' own site, she has to be crazy to post pictures like these that show what looks like serious health code violations.  Now we are not saying that these are violation, we are going to let the health department determine that.  They have already been contacted from what we have been told.  We were just told to check out the site and this is what we found.  No telling what the Health department is going to find.  We will pull and publish their findings when the time comes.  In the mean time, the pictures speak for themselves.  Straight off their Facebook page.

Federalist Papers Number 3, John Jay, Dangers From Foreign Force and Influence




John Jay continues the arguments on the Dangers from foreign force and influence on this new nation.  Seeing how our US Constitution came about through the arguments of the day surrounding our founding fathers.  Liberty Education Series here on GVLN.



We found this video to be rather interesting and thought it would be a great addition to help everyone understand the issues of the day and how they all played out.  We will be publishing all 85 Federalist papers and all of the Anti Federalist papers as well.  As we can, we will search for the most relevant videos to help you fully understand each area.

Recipe For Rare Gloucester Banbury Cake

Take a peck of fine flower, and halfe an ounce of large Mace, halfe an ounce of Nutmegs, and halfe an ounce of Cinnamon, your Cinnamon and Nutmegs must be sifted through a Searce, two pounds of Butter, halfe a score of Eggs, put out four of the whites of them, something above a pint of good Ale-yeast, beate your Eggs very well and straine them with your yeast, and a little warme water into your flowre, and stirre them together, then put your butter cold in little Lumpes:

The water you knead withall must be scalding hot, if you will make it good past, the which having done, lay the past to rise in a warme Cloth a quarter of an hour, or thereupon; Then put in ten pounds of Currans, and a little Muske and Ambergreece dissolved in Rosewater; your Currans must be made very dry, or else they will make your Cake heavy, strew as much Sugar finely beaten amongst the Currans, as you shall think the water hath taken away the sweetnesse from them;

 Break your past into little pieces, into a kimnell or such like thing, and lay a Layer of past broken into little pieces, and a Layer of Currans, untill your Currans are all put in, mingle the past and the Currans very well, but take heed of breaking the Currans, you must take out a piece of past after it hath risen in a warme cloth before you put in the currans to cover the top, and the bottom, you must roule the cover something thin, and the bottom likewise, and wet it with Rosewater, and close them at the bottom of the side, or the middle which you like best, prick the top and the sides with a small long Pin, when your Cake is ready to go into the Oven, cut it in the midst of the side round about with a knife an inch deep, if your Cake be of a peck of Meale, it must stand two hours in the Oven, your Oven must be as hot as for Manchet

The above recipe is very old and needs to be converted to more of a modern recipe.  It's fascinating to see how descriptions were once communicated.  This is from one of our rare old recipe book collections.

How The Gloucester, VA Board of Supervisors Meeting Work, Robert's Rules of Order

Ever wonder how a Board of Supervisor's meeting works or how it is structured?  Ever wonder how they come up with their rules?  So did we, so we set to find out just what those rules are and how they work.  The Gloucester County, Virginia Board of Supervisors are allowed to pick a form or structure for how the meetings are to be conducted each year.  For 2013, Robert's Rules of Order is the format that Gloucester County uses for it's Board of Supervisors meetings.

Above is a complete, yet older version of Robert's Rules of Order.  Devised by Henry Robert back in the 1800's/  The first pocket edition was published in 1876.

The book is designed for use in ordinary societies rather than legislative assemblies, and it is the most commonly adopted parliamentary authority among societies in the United States.[2] The book claims to be a "codification of the present-day general parliamentary law (omitting provisions having no application outside legislative bodies)".[3] This statement does not imply any approbation on the part of the courts, and the "general parliamentary law" is related neither to statutory legal requirements nor to common-law precedent derived from court judgments.

Being widely accepted, and being based for the most part on long-standing traditions of parliamentary procedure, however, the current edition of the book is a reliable reference. Nevertheless, the provisions of any particular manual are not, as a general matter, legally binding upon an assembly that has not formally adopted it as its parliamentary authority; any such manual can at best be cited as "persuasive".[4] In addition, a number of changes have been made to recent editions, such as provisions dealing with videoconferences, teleconferences, and email, which now makes these editions more than merely codifications of the "present-day general parliamentary law" as existed at the time Robert was originally writing.

County Board of Supervisors" target="_blank">Board Rules of Procedure 2013 Gloucester County Board of Supervisors from Chuck Thompson

As seen above, for 2013, the Gloucester County, Virginia Board of Supervisors has adopted Robert's Rules of Order for the structure of public meetings.  

Arguments of Suppression:

Previously we argued that it looked to us like the Board of Supervisors were purposely suppressing public arguments by time limits.  Is the argument valid?  Let's say it is a valid argument based on the fact that the Board can set time limits on the public based on Robert's Rules of Order, however, there is on the other hand, no basis of law on that time limit at that juncture.  Let's look at the present county rules for speakers.

" Speakers At every Public Hearing, speakers wishing to address the Board shall clearly state their name and address or magisterial district, if applicable, and they shall be allowed to speak for no more than the time limit set by the Chair

. Each speaker may address the Board as many times as the Chair may allow, but no speaker shall exceed the total time limit set by the Chair regardless of the number of times recognized by the Chair.

 The Parliamentarian shall be responsible for noting the expiration of this time limit, and the Chair shall be responsible for enforcing said limit. All speakers shall direct their comments to the Board Chair. Speakers may register with the Clerk prior to the start of the hearing if the Chair feels it is necessary on forms provided for citizen participation, and the Chair shall verify that all such registration has been completed before beginning the hearing with the first step described above in Section 4-1. The Code of Gloucester County,

 Section 2-13, allows the Chair to recognize any citizen to speak to the Board during the course of any meeting if deemed appropriate, and requires the Chair to recognize a citizen when requested by two (2) or more Board members. Section 4-3. Member’s Participation Board members shall limit their comments during public hearings to ensure full participation by the public without Board interference."

Section 4-1. Format for Public Hearings

The following format shall be followed for all Public Hearings conducted before the Board of Supervisors, except for those conducted by representatives of the Virginia Department of Transportation:

• The Chair will make a brief statement identifying the matter to be heard and verify with the County Administrator that all legal advertisement requirements have been met.

• The Chair will call upon the appropriate County staff member to present the item to be heard. Staff presentations should be concise and normally limited to no more than ten (10) minutes except when necessary to properly inform the public of the issue before the Board. In a land use matter, unless otherwise agreed by the Board, the applicant or the applicant’s representative(s) shall be allowed a maximum of ten (10) minutes to present their case immediately following the staff presentation.

• The Chair will open the floor to public comment.

• The Chair shall close the floor to public comment, and refer the matter for Board discussion.

Arguments based on the above, Gloucester County's own format:

1.) Nowhere is a preset time limit given for any speaker from the public given.
2.) No laws are quoted for time limits, other than one may be set, for a public speaker, which is not a law but rules of order.
3.) The only time the public sees a time limit is when a public meeting is announced on a given topic.  The time limit is arbitrary and can be changed at will.
4.) We have noted that when a topic is a hot debate and the county wishes to restrict that debate, the time limit is restricted to a very low level, usually 5 minutes.  

One will note with great interest, the video from the Gloucester County Board of Supervisors meeting, below, that there was no public speaker time limit given on a subject of very low interest.  Yet once the school bond issue came up, it was made very clear that any member of the public had only 5 minutes to speak.

The school bond issue was a very hot topic.  The 5 minutes were in fact enforced on one person who had more to say.  That person was suppressed from having her say.  (You can see the entire video at the bottom of this site).

The case of the Gloucester County Board of Supervisors should now be very clear about suppressing unwanted information in opposition to what the Board of Supervisors wants to push through regardless of what the public wants.

How to beat the limitations on time.  According to the information above from the Board of Supervisors own meeting rules, if you want to address an issue at the public hearing or before any part of the meetings begin to open up a certain topic, you can register ahead of time to do so.  You can also submit how long that presentation will last.  It takes advanced planning and timing, but it is one option.

Option two.  Tag team.  If you will need to make sure your message is heard, you can create a tag team of people who will each present a part of the total argument and still keep within the time frame that the Board of Supervisors has set for each person.  One can also argue the time limitations set by the board and challenge the time limitations requesting to know how that time limit was set for the particular topic and request justification for that time limit. 

If you understand how all of this is set up, you can work within it's limitations and still beat them.  There is always a loophole.  Even if the Board closes that loophole, there are always others.

Government is by the consent of the governed.  People should not be afraid of their government, the government should fear the people.  (Old historical quote).

On a final note, we would like to show the Gloucester County, Virginia Board of Supervisor's Code of Ethics and ask if they are in violation of their own codes.

Gloucester County Ordinances Repealed, August, 2013

Gloucester County ordinances that were repealed during the August, 2013 Board of Supervisor's meeting.  Not very thrilling reading until you realize that the arguments for repealing these ordinances are ones that Ted Wilmot are arguing against for repealing Animal Control ordinance 3-17.  (See our other posts over this argument).


ORDINANCE TO REPEAL CHAPTER 6 DEMONSTRATIONS AND PARADES OF THE GLOUCESTER COUNTY CODE WHEREAS,

 Board of Supervisors has been made aware that Chapter 6 of the Gloucester County Code has historically not been enforced, is not supported by any regulatory necessity, and is, in some respects, redundant of State law, since the Virginia Department of Transportation (VDOT) has in place special event guidelines and approval processes for parades and demonstrations upon any state maintained highway.

 WHEREAS, the Board has held a duly advertised public hearing on this matter; and

 WHEREAS, the Board wishes to repeal Chapter 6 of the Gloucester County Code in its entirety.

 NOW THEREFORE BE IT ORDAINED by the Gloucester County Board of Supervisors this 6th day of August, 2013 that Chapter 6 of the Gloucester County Code is hereby repealed.
Is the Gloucester County Board of Supervisors and Ted Wilmot speaking from both sides of their mouths?  On the one hand, they can not support the Dillon Rule for Animal Control ordinance 3-17, they say it is supported by a mosaic of state codes, but above they show that redundant ordinances are not needed where it does nothing for them?  They will not address how the mosaic of states codes to create a new ordinance changes the overall perspective of those state codes in ways that were not meant to happen.  (Are you suprised?)

This is your tax dollars working hard to cause you issues?  Yet when they have to change an ordinance these days, they are actually trying to follow what is right?  Here is the September Public Hearing Notice for 2013.


PUBLIC HEARING NOTICE
The Gloucester County Board of Supervisors will conduct a Public Hearing on
September 3, 2013, beginning at 8:00 p.m. in the Colonial Courthouse located at 6504
Main Street, Gloucester, Virginia, to consider the following:
AN ORDINANCE AMENDING CHAPTER 22-PROCUREMENT
OF THE GLOUCESTER COUNTY CODE
Due to the passage of SB 902 by the 2013 General Assembly, an amendment to the
Gloucester County Code, Chapter 22 – Procurement is needed to align the County’s
procurement ordinance to this new mandatory requirement of the Virginia Public
Procurement Act. The amended requirement became effective on July 1, 2013.
The amended statute allows for the acceptance of a cashier’s check as an alternate
form of security in lieu of a bid, payment, or performance bond. Accordingly Section 22-
39 (a) of the Gloucester County Code requires amendment allowing for the acceptance
of a cashier’s check as an additional form of security.
A complete copy of the proposed ordinance amendment is available and may be
reviewed at the Gloucester County Administrator’s office at 6467 Main Street,
Gloucester, Virginia, on the web at www.gloucesterva.info and at both branches of the
