Gloucester, VA What Glo-Quips Didn't Tell You, July, 2014

If you caught this paper or if you missed it, there is a good deal you were not told about the story.  So we are going to fill in the holes for you.

Here is the crux of the story.

Sec. 3-18. Animals in enclosed vehicles.permanent link to this piece of content

(a)
It shall be unlawful to leave any animal in a vehicle without the benefit of air conditioning when the outside temperature reaches eighty (80) degrees fahrenheit or greater.
(b)
Any person who confines an animal in an unattended vehicle so as to cause the animal to suffer from heat stress, shall be guilty of a Class 1 misdemeanor. The animal control officer or other officer shall have the authority to remove any animal found in an enclosed vehicle that appears to be suffering from heat stress. The animal shall be provided immediate veterinary care. The animal owner or custodian shall be responsible for all expenses incurred during the removal of the animal or its subsequent treatment and impoundment.
(c)
In the event that the person responsible for the violation cannot be ascertained, the registered owner of the vehicle, as required by Chapter 6 of Title 46.2 of the Code of Virginia, shall constitute in evidence a prima facie presumption that such registered owner was the person who committed the violation.
(Ord. of 7-1-2008(1), § (2); Ord. of 2-5-2013(1))

That's the entire story inside the paper.  It came out after we brought up the following with a number of county officials.

Now what is interesting here is that a local ordinance can not supersede state code nor Federal Laws.  According to everything we have looked up, neither the local government nor the state government can regulate vehicle manufacturers and what is required in a vehicle.  So we see Gloucester thinks it can supersede state and Federal rules?

Here is a copy of an email we sent to the Sheriff's department.

 Greetings;

We want to help.  Since we can not find any State codes that are equal to Gloucester County AC Section 3-18, we have started a campaign to help get this to both the State and Federal Government.  We have contacted the State Attorney General asking him to look into getting state codes created to fall into compliance with our county ordinance.  We have also contacted Congressman Rob Wittman and Senator Mark Warner as well as President Obama asking that they get together and create laws to get into compliance with Gloucester County.

The following is exactly what we sent out to the above;

Greetings (Addressed to the person in question);

I am wondering why I am unable to find a state code or Federal Law that is in compliance with a Gloucester County, Virginia Ordinance, Animal Control Ordinance 3-18.

Sec. 3-18. Animals in enclosed vehicles.permanent link to this piece of content

(a)
It shall be unlawful to leave any animal in a vehicle without the benefit of air conditioning when the outside temperature reaches eighty (80) degrees fahrenheit or greater.
(b)

I am asking that the state of Virginia and Federal Government work together and please look into this and get into compliance with Gloucester County, VA ordinance 3-18.  Municode Link is https://library.municode.com/index.aspx?clientID=10843&stateID=46&statename=Virginia

To show how the state and Federal Government is in fact out of compliance with local ordinance.

Now to offer some more ideas, we are working on building an email campaign to send to all of the vehicle manufacturers demanding that all vehicles sold in the USA and Canada now be equipped with Air Conditioning as it is unknown if any of those vehicles will ever come through Gloucester County transporting an animal during temperatures above 80 Degrees and we do not need people committing criminal acts in this county.

We see several opportunities for generating revenue from this that we would like to share with you.

1.)  We would recommend that deputies now go throughout the county, to each car lot and or anyone who is selling a vehicle and make sure that the vehicle has a working air conditioner.  If it does not, then a fine should be imposed on the seller for each violation and the vehicle should be removed from future sale until it meets compliance.

2.)  Meeting this compliance may cause some people undue burdens, so we are also recommending selling a mandatory county decal that creates a statement from the owner that the vehicle does not have air conditioning and thus will never be used for transporting animals at anytime where temperatures meet or exceed 80 degrees.  Even if the purchaser does not own an animal, this decal should still be made mandatory as one never knows when they will be called on to transport any animal from a neighbor, friend or road emergency.  This would take care of any issues from 1 above.

We also believe that people should be prosecuted for violations to this county ordinance.  We would like to suggest that the Sheriff's office please start with 4 people we know who are violating this policy right now.  Gloucester Animal Control has 4 trucks in violation of this code right now and these criminals need to be made examples of.

Please forward a copy of this email to Sheriff Darrell Warren.

If you have any comments, suggestions or more ideas, please do not hesitate to contact us.  We are more than happy to help with this vital issue.

We sent out emails last night and have already heard from Senator Mark Warner.  His email is as follows.

I appreciate the trust and confidence you have shown in me by contacting me with your letter in which you requested my assistance with your question regarding federal codes protecting animals.

In an effort to be of assistance to you, I have referred your letter to the Congressional Research Service (CRS)I will promptly forward any information I may receive from CRS to you.

My staff and I stand ready to be of assistance in any other matter that is of concern to you.

Sincerely,
MARK R. WARNER
United States Senator

All we can say at this point is that if the county government is going to make up it's own ordinances, it better be prepared for the consequences that go along with them.  We will keep you up to date with this story as it progresses.

Man Found Alive Days After Motorcycle Crash

By    Catherine Rogers

Gloucester, Va. (WAVY) - A man was found alive on the side of a Gloucester highway Monday after crashing on a motorcycle days before.

Virginia State Police was contacted Monday by the Gloucester County Sheriff's Office to investigate the discovery of a motorcycle crash, according to Corinne Geller with the VSP.

A 2002 Kawasaki motorcycle had been traveling west on Hickory Fork Road when it left the right side of the roadway and overturned about 20 feet from the wood line. The motorcycle slid several more feet into underbrush and struck several trees.

The motorcycle's operator, 28-year-old Daniel G. Cain of Gloucester, was found with broken bones and bug bites about 15 yards away from the highway. He was flown to Sentara Norfolk General Hospital with life-threatening injuries.

Cain's mother, Victoria Jurgensen, told WAVY.com last Wednesday night was the last time she'd seen him, as he left home on his motorcycle to grab a sandwich at a nearby Wawa.

"It's not like him, so we thought he went, saw a girl, he overslept," Jurgensen said. "We waited for him to call, no call, didn't call his boss, didn't call my husband, didn't call me."

Cain, an army reservist, didn't show up for duty over the weekend either.

"The military is his first love, and I knew something was wrong," said Jurgensen.

So she filed a missing persons report with the Gloucester County Sheriff's Office.

"I thought they would start looking for him, did they? No," she said.

Jurgensen took matters into her own hands and enlisted family and friends to search for her son. They searched over the weekend with no luck, but on Monday, family friend Kellie Green and Katrina Welch searched on foot down Hickory Fork Road -- the road to Cain's home. While walking -- and Green saw something.

"So I seen the shoe and I started walking a little further and I saw a pack of cigarettes, and then right here in this area I saw something shiny, and I picked it up and it was a mirror to a motorcycle," Green said.

Green and Welch went into underbrush and found Cain alive and his motorcycle, completely out of view from the highway.

"I was putting up fliers when I got the call from my husband: 'They found Daniel. You need to get back to Hickory Fork Road' ... 'he's alive,' that's all I could think," Jurgensen said.

Geller said the crash happened several days before Cain was found, but it is still uncertain exactly which day.

Jurgensen said her son is still recovering from his injuries.

The crash is still under investigation.

Comments:
Comments from area citizens about the local county sheriff's office involvement are rather comical.  Where was the local concern?

Were they all out having donuts and just didn't want to be bothered?  In all honesty, there are mixed reviews about local law enforcement.  There are some really good people with the department and there are some really bad ones.  So guess it depends on who you talk to when you ask for help.  If you get one of the bad one's, what do they care?  If you get one of the good one's, you can never thank them enough as they have shown to go out of their way for local residents.  Plus anyone can have an off day.  Not an excuse, but it still happens.

It's a shame that these folks had to experience the bad side of local law enforcement.  Thank God this guy was found still alive and our prayers go out to him and his family.  Looks like the local Sheriff's office has some community repairs to make to their image now.

Sunrise Donuts of Gloucester, VA - Multiple Health Code Violations? Hairy Donuts Anyone?

Gloucester, VA Facebook Page" target="_blank">Sunrise Donuts of Gloucester, VA Facebook Page from Chuck Thompson

We created a PDF version of the Sunrise Donuts Facebook page.  The page is wide open to the public and anyone in the world can view it.  However, once they are aware of their own posts, they are sure to remove some very questionable pictures from their pages.  This PDF shows how the site looks with what we see as some potentially serious health code violations.

https://www.facebook.com/pages/Sunrise-Donuts-and-Sweets/197666766987760  Link to the Sunrise Donuts Facebook Page.

Hairy donuts anyone?

How many potential violations can you see here?  No hair net?  No food handlers gloves?  Paint Bucket for mixing dough?  Power drill used for a mixer?  Unsafe conditions as she is kneeling on a step ladder?  August 17th, 2013.  Note the commercial mixer in the background not being used.  Background sign also states only paid staff allowed in the kitchen.

Again, no hair net or hat?

No hair net, not food handler's gloves.

We have a hat this time, but still no food handler's gloves.  She is handling the donut.

In front of a deep fryer?  No hair net no food handlers gloves.

Is this a sign of a minor who has been drinking on the job?  Is this something that is allowed and possibly even a common practice at this shop?  From what we know, this girl is a minor.  Open beer bottles and liquor bottle in the Kitchen of Sunrise donuts?  What's in those donuts anyway.  Also, what is in the bag under her arm?  Big bag of marijuana?  Spice donuts anyone?  We have no idea what is in the bag, but the picture sure looks highly questionable.

Is this guy on the clock?  Did he pay for that donut?  Did he get more in that donut than he bargained for?  Is that a special spice donut?  Beer infused maybe?  This is their pictures.

On another note, look at the logo at the top left hand side of the site, Sunrise Donuts and Sweets Shop at the top, Home of the "Crazy Chic" at the bottom.
From what we are seeing here on Sunrise' own site, she has to be crazy to post pictures like these that show what looks like serious health code violations.  Now we are not saying that these are violation, we are going to let the health department determine that.  They have already been contacted from what we have been told.  We were just told to check out the site and this is what we found.  No telling what the Health department is going to find.  We will pull and publish their findings when the time comes.  In the mean time, the pictures speak for themselves.  Straight off their Facebook page.

Makes ya wanna go git some huh?  We will pass, thanks.

Darrell Warren Laughing All The Way To The Polls On Tuesday

Present acting Gloucester County Sheriff, Darrell Warren was overheard in a local place laughing with his friends about his upcoming election.  Mr Warren does not really have any real threat contenders running against him in this campaign.

Mr Warren's only contender is Clarence Bowser who has run in past elections and at best has only managed to collect about 5% of any of the votes.  We find it very interesting that Darrell Warren is going for the most part uncontested in this non race, race.  In the past, there have been a number of people who have stepped up and shown interest in the Sheriff's position.  The contest in the past however was against Steve Gentry.  Last year Steve Gentry stepped down from the position right after just having won the election.

It was a very strange move for someone who had just won an election to all of a sudden step down.  Inside word as to the real reasons are shocking, however, we will not reveal what we know on this at this time.  We have nothing against Darrell Warren as we do not even know the guy.  We just find this race at this point and time to be highly unusual.  If you do not like either choice, write in for someone else instead of leaving the option blank.  Let your vote count.

Gloucester, VA Sheriff's Race - Two Candidates Now On The Ballet

Republican Party (United States)
Republican Party (United States) (Photo credit: Wikipedia)
Clarence Bowser and Darrell Warren are the two candidates now seeking election this fall for the Sheriff's position.  Clarence Bowser is running as an independent and Darrell Warren is running under the Republican platform.  There are no other challengers to Darrell Warren from inside the Sheriff's Office this time although Clarence Bowser is an ex sheriff's deputy from the Gloucester County Sheriff's Office.

This is not the first time Clarence Bowser has run for this position but he gets very little local press compared to other candidates in past campaigns.  Clarence has written a book and it is available on Amazon.  The name of that book is Penalty of Justice: The Pro Se.  CLICK HERE to see the title on Amazon.  You can also read a good section of the book to get a feel for it right on the Amazon site.

A section above seems to have a misspelled word after star which should read medal.  In the opening is a misused word, tricky should read trickery.  The above is re printed under fair use laws for this news story.

Holli M Cohoon Continues Her Attacks On Victim

Holli M Cohoon, the 911 operator who gave phony testimony against the victim we have been reporting about continues her attacks on the victim.  We have added this copy of yet another petition for a protective order coming from Holli.  This one delivered after the other one expired.

We removed the victim's name from the document. This particular order has a court date added to the bottom.  August 2nd, 2012 at 3:00 PM at the Gloucester County Court House.  Something that was missing from the Emergency Protective Order.

Now anyone can get an emergency protective order against anyone else at any time.  The procedure is quite simple.  You just have to stand before a Magistrate and state a complaint and the order will be given.  Get to this next level is much harder however and the nasty little trick that Gloucester County used to create this one was very underhanded and will be our next article.

Also, from what we have been informed, the way in which this order was delivered was highly questionable.  Here is what we have been told in the way in which this was handled.  Numerous Gloucester County Sheriff's Deputies delivered this describing this only as a two week extension of the first order and that there could be a third extension.  They were very sure to point out that this was only an extension.  Not a summons to appear in court.

Now why would the Sheriff's Deputies do this?  Were they hoping that by misrepresenting the paper that the victim in this case would not bother to read it?  Maybe then not bother to show up in court?  That is what we are betting on.  Now what could possibly be gained by doing such a nasty trick?  We will cover that in another story.

911 Dispatcher Liability?

911 Dispatcher Liability?

As we have shown in our last article, the testimony from Holli M Cohoon falls way short and inaccurate. There are legal liabilities for giving false and misleading testimony in a court of law, especially when said testimony proves to harm any person against whom the false testimony was given. Holli may just find herself working the rest of her life to pay restitution for the harm caused, and reporting and accounting for every dollar she earns every month.

Arrangements have been made to forgive any and all potential damages in exchange for her true and accurate testimony. This is a very short time offer as her testimony isn't really needed. She has two weeks from today's date to come forward. After the two week period, all bets are off.
