Police In All 50 States Now Liable For Abuses? Yes According To Findings.

For Immediate Release

10.27.11

North Carolina Police Departments all over the state have warned their officers to put their personal property (houses, land, cars and other assets) into someone else's name because they may now be subject to lawsuits from the People of North Carolina.

The warning was issued in response to the recent ruling that upheld that the local Police Departments in North Carolina are classified as "private entities" and NOT connected to the state of North Carolina.

Judicial Review Judge, Paul C. Ridgeway, Wake County General Court Of Justice, Superior Court Division, upheld a lower court ruling that most Public Officials / Agencies are "private entities." Judge Ridgeway upheld the earlier (1.17.11) ruling of lower court Judge J. Randall May in Class v. NORTH CAROLINA, Case No. 10 DOT 7047 (now known as 11 CVS 1559).

The police officers will now also have to fund their own Surety Bonds.

Judge Ridgeway's September 15, 2011 ruling creates a conflict in the public's perception of basic government legitimacy because Judge Howard E. Manning, Jr (who recused himself in August 2011) declared in Mr. Class' 4.21.11 hearing that "the Defendants were NOT 'private entities' or 'private contractors' ", but were "public officials."

Are the judges confused ? Are these "government" agencies and officials NOT what they're portraying to their constituents ? Are they immune because they're "private" ? Do we actually have government "agencies" and elect "Public" Officials OR do we deal with "Private Entities" ? Is the public being frauded ? So many questions ! So many conflicts !

Here's some background:

Mr. Class' original suit (Case No. 10 DOT 7047) accused the named North Carolina State departments and individuals with charges of Embezzlement of Federal funds from the local political subdivisions, and violations of the Right To Travel issue.

Mr. Class was acting as a Private Attorney General under provisions of an 1866 Federal Act, and was acting on behalf of all People, and political subdivisions "similarly situated" and affected by the charges in his Judicial Review.

Mr. Class has posted all of his filings, and responses from the court, and the defendants, on the Internet at various sites for the benefit of those in their efforts and interactions with these purported "private entities"

(contractors), and to ensure that these rulings stay in the public domain and do not disappear !

Other Notes from other sites on this.

What does this mean? It means that Police can't abuse you or take away your rights and then seek cover and immunity because they were "in the performance of their duties". Get clubbed, get tazed, be unlawfully searched like at those random highway checkpoints, and you'll be able to sue that Officer in Court.

Hey, I know you support Law Enforcement, they keep us safe, or they're supposed to. But as America slides into a Police State you need to know that you aren't just a "subject" to be pushed around.

WOW: great citizen reporting from Henry John and VERY interesting though ideally we need confirmation: Henry John

Incredible must read PDF file regarding this matter.

If you are not paying very close attention to this, this does cover all 50 states as the information in this case used Federal law to argue the case.  This means that these same arguments are valid in all 50 states whether or not the states like it.

Every so called official is subject to lawsuits when they violate any of the laws of the state or federal government and that person is not covered by whom they are employed.  In other words, if you seek to sue a police officer, then police officer has no protection from the police department and must pay his or her own court costs for any lawsuit.  So now there is no top cover for anyone in so called government.

So it looks like if some police officer delivers a search warrant to you, it has no validity as it has not come from an actual official government body?  That's what this looks like.  Throw the bums off your property?  Of course this requires a great deal more research, but we are going to stay on top of all of this.  The implications are unreal and a very serious game changer.

In the state of Virginia, there is no state oversight of localities and this may very well be the reason why.  With this being the case, it may just come out that localities have no jurisdiction on anything and that could open a tremendous amount of lawsuits everywhere.  That includes against all the judges as well.  Anyone wondering why the main stream news isn't touching this story?

Now here is an Mp3 file that is 27 minutes long that is a must listen to.

Secretary Haymore Unveils Southern Virginia Wine Region Road Signs

~ Sign Program Promotes Virginia’s Burgeoning Wine Industry, Diverse Wine Regions and American Viticultural Areas ~

Program reflects partnerships involving Agriculture, Transportation and Tourism

CHATHAM –  Secretary of Agriculture and Forestry Todd Haymore unveiled the Southern Virginia Wine Region road signs, part of a continuing Virginia wine region sign program aimed at attracting more visitors to Virginia wineries.  The unveiling was the first event of Governor Terry McAuliffe’s two-day cabinet visit to Southern Virginia.  The signs announce to travelers on selected primary and secondary roads that they have entered a particular Virginia American Viticultural Area (AVA) or wine region.  Now in its second phase, the program has located almost 40 signs in thirteen Virginia AVAs and wine regions.

The Southern Virginia Wine Region sign was unveiled at The Homeplace Vineyard in Chatham.  Incorporated in 2004, The Homeplace Vineyard is owned and operated by the Williams Family.  Held in the same family over the last 4 generations, The Homplace was traditionally a leaf tobacco farm, planting its first grapes in 2005.  The family now cultivates 5,600 vines on almost 10 acres, raising Traminette, Cabernet Sauvignon, Chambourcin and Viognier, the official wine grape of the Commonwealth.
Running across the middle of the Virginia’s border with North Carolina, this mostly rural and rolling landscape of farms and woodland takes visitors into the south-side Virginia version of small-town America. Southern Virginia has a warm to temperate climate with good soil for winemaking in selected areas where the topography is ideal.  Cabernet Franc, Cabernet Sauvignon, Chardonnay, Merlot, Syrah, Pinot Grigio and Vidal Blanc are the most produced grape varietals in this region of the Commonwealth.
The wine region sign program was funded by a grant from the federal Transportation Enhancement Program and matching funds from the Commonwealth Transportation Board (CTB).  The Office of the Secretary of Agriculture and Forestry worked closely with Virginia Department of Transportation (VDOT) to design the signs and select locations that fit within the rules of the program and were best situated to promote the wine regions.  The Virginia Wine Board will assist with any maintenance should a sign be damaged or destroyed.

“I want to thank Governor McAuliffe, Transportation Secretary Aubrey Layne, CTB, VDOT, and the Virginia Wine Board for their assistance in making these wine region signs a reality,” said Secretary Haymore.  “The continued growth of Virginia’s wine industry, one of the fastest growing sectors of Virginia agriculture, is a priority for Governor McAuliffe and cross secretariat cooperation is key to the Governor’s overall economic development and jobs creation agenda.  This partnership, along with our on-going work with the Virginia Tourism Corporation, will help spur more growth and opportunities at wineries and their suppliers in rural areas throughout Virginia.”

“The Transportation Secretariat partners with the Secretariat of Agriculture and Forestry on everything from road signage, to weight restrictions, to the safe use of farm vehicles on Virginia roads,” said Virginia Secretary of Transportation Aubrey Layne. “Our secondary roads are vital to those who work the land. Continuing to maintain the positive partnership between our two secretariats is a huge benefit to the farmer as well as the consumer.”

Raising the profile of Virginia wines and wine tourism, along with the production of top quality wines, are key components in the recent strong growth of the Virginia wine industry.  Continuing to promote Virginia wines at the Virginia Executive Mansion and throughout Virginia, on other domestic business recruitment visits, and on upcoming international trade and marketing missions, Governor McAuliffe is making the continued growth and success of the Virginia wine industry a priority in his administration.

Virginia is home to more than 250 wineries and is fifth in the nation for wine grape production.  A 2012 economic impact study shows that Virginia's wine industry contributes almost three-quarters of a billion dollars - or $747 million - annually to Virginia's economy.  Virginia wineries and vineyards support 4,800 jobs that provide $156 million total in wages.

Wine travel in Virginia has gained many recent accolades, including being named one of the ten best wine travel destinations in the world for 2012 by Wine Enthusiast Magazine.  In 2010, approximately 1.6 million people visited Virginia wineries.  Tourism is an instant revenue generator for Virginia.  In 2010, tourism generated $19 billion in revenue, supported 204,000 jobs and provided $1.2 billion in state and local taxes.

Governor McAuliffe Announces Resumption of Virginia Poultry Exports to China

RICHMOND – Virginia Governor Terry McAuliffe announced today that after almost seven years Virginia poultry exports will resume to the People’s Republic of China.  The McAuliffe administration learned earlier today from Chinese and U.S. officials that the ban, instituted in July 2007, has been rescinded by China’s General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) and China’s Ministry of Agriculture (MOA).

“This is outstanding news for Virginia’s poultry industry and the many related businesses that work to move product from our family farms into the global marketplace,” said Governor McAuliffe.  “Strengthening Virginia’s economy is my number one priority and the lifting of this ban is certainly good news for Virginia’s economy.  Poultry is the largest individual sector of Virginia’s agriculture industry and increased exports will help support farm, processing, and transportation related jobs in the Commonwealth. This will also bring enormous business benefits to the Port of Virginia at a critical time for that entity.”

In recent months, Governor McAuliffe and Virginia Secretary of Agriculture and Forestry Todd Haymore have discussed the issue with top officials from China’s Embassy in Washington, D.C., including Ambassador Cui Tiankai; the newly appointed United States Ambassador to China, Max Baucus; United States Secretary of Agriculture Tom Vilsack; and United States Trade Representative, Ambassador Michael Froman.  The McAuliffe administration’s focus on resolving this trade issue built upon work that Virginia officials, including former Governor Bob McDonnell, Senator Mark Warner, Senator Tim Kaine, Congressman Eric Cantor (R-VA 7th), Congressman Bob Goodlatte (R-VA 6th), and Congressman Robert Hurt (R-VA 5th), among others, have done over the past several years to re-open the Chinese market to Virginia poultry.  Hobey Bauhan of the Virginia Poultry Federation, Jim Sumner of the U.S.A. Poultry & Egg Export Council, and others in the private sector have been instrumental in Virginia’s work with U.S. authorities and Chinese government officials.

“Addressing China’s ban on Virginia poultry has been a real team effort,” added Governor McAuliffe, referencing work conducted by staff from the Virginia Department of Agriculture and Consumer Services (VDACS) in coordination with federal officials from the United States Department of Agriculture Animal Plant Health Inspection Service (USDA APHIS) and the Office of the United States Trade Representative (USTR).  “The USTR and USDA made resolution of this issue a priority and worked closely alongside Virginia’s individual efforts to address the matter.  I also want to thank Ambassador Cui and the Chinese Embassy staff for their attention and work to resolve this important issue.”

Since 2007, following an isolated case of low pathogenic avian influenza (LPAI) reported on a single farm in Virginia, China has maintained a ban on all poultry produced in Virginia, poultry transiting through Virginia, and poultry that is exported from any port in Virginia.  Virginia officials have long contended that China’s ban was not justified by scientific data, as the isolated LPAI occurrence did not pose a food safety or poultry health risk.  Because of the ban, Virginia had been excluded from taking advantage of business in this high growth market.  China is currently one of the top foreign markets for U.S. poultry, purchasing more than $416 million in 2013, with Georgia, Mississippi, and North Carolina as leading suppliers.

Virginia’s work to resolve the ban with federal and Chinese officials began in late 2007 under then-Governor Kaine.  During Virginia trade missions to Asia in 2011 and again in 2013, then-Governor McDonnell and Secretary Haymore held meetings with government officials in China regarding the poultry ban.  As a result of discussions with Chinese officials, in March of 2013, Virginia worked with federal officials from USDA APHIS and USTR to host a technical delegation from the Chinese regulatory agencies that were responsible for the ban.  The technical delegation conducted site visits and meetings in Virginia, examining farm and food safety protocols and testing.  This work, along with other efforts over the last seven years, ultimately led to the resolution of the ban.

“Based on China’s current poultry purchases from other nearby states, we believe that Virginia stands to gain $20 million or more in export sales each year,” stated Haymore. “China is a good market for certain items that are not of high value in the domestic market, but can be an important income generator for poultry processors.  Chicken feet and wing tips are considered a delicacy in some parts of China.  Reopening the market to these Virginia products adds commercial value to the product.  Chicken feet and wing tips may be worth a few cents per pound in the domestic market but can sell for many times this amount in China.”

China ranked as the number one market for Virginia’s agricultural exports in 2013 with more than $580 million in purchases.  However, the country’s market has remained closed to Virginia poultry products for the past seven years.  The total value of Virginia poultry exports exceeded $186 million in 2013, with China absent as a major potential market for Virginia.   Agricultural and forestry exports from Virginia reached a record high of $2.85 billion in 2013.

The poultry industry is the largest individual sector of Virginia’s agriculture industry.  With annual farm cash receipts in excess of $950 million, poultry accounts for more than 30 percent of all Virginia's cash receipts from agriculture.  Virginia's poultry industry depends on fair access to foreign markets in order to support continued prosperity.

According to a 2013 economic impact study conducted by Weldon Cooper Center for Public Service at the University of Virginia, agriculture is Virginia’s largest industry, generating more than $52 billion per annum. The industry also provides more than 310,000 jobs in the Commonwealth.

Dems launch “a series of blistering attacks against the Kochs and their ads.

Friend -- The Kochs’ deceptive attacks are working: A new PPP poll shows that $8.3 MILLION in Koch lies have erased Kay Hagan’s (D-NC) 15 point lead. She’s now tied with all eight GOP challengers in Nate Silver’s “tipping point state” -- what he calls the GOP’s “best option [for] ... a 51-49 Senate majority.”

We’re urgently fighting back with our Koch Accountability Project -- and launching new ads to counter their deceitful attacks, turn this around, and win. If we can get this off the ground, the New York Times reports that we will expose the TRUTH: “the fundamental purpose of the Kochs’ spending is to rig the economic system for their benefit.”

But if we fall short, the Kochs will buy the Senate for the GOP in an agonizing defeat for Democrats. We still need you and 7,000 more Democrats on board -- will you step up today?

Will you pitch in $3 to the Koch Accountability Project to reveal the truth about the Kochs’ disgusting lies and STOP a Republican Senate takeover?

Thanks for your support,
DSCC Breaking News

P.S. We can’t let the Kochs’ despicable lies cost Democrats the Senate. Will you step up before Friday to stop them?

Our Notes:  The game continues to be played at all levels and both sides.  These same tricks are played by the democrats and now that it's being played against them, they are crying foul?  Please.  It's all fixed at every level.  Most decent people will not run because the game is so fixed and dirty.  Instead, people are forced to run for one reason or another in so many campaigns from what we have uncovered.  We pulled out the links from the above.

Expose the truth?  Who's truth?  Are the democrats going to illuminate us all?  We have shown you what illumination is and where it comes from.
