Gloucester, Virginia Public Schools’ Administration Attempts to Coverup Felony Theft

In May 2017 we brought you a story about rumors of theft from Gloucester County Public Schools’ (GCPS) bus garage. The rumor described an employee stealing a welding machine (welder) and when the theft was brought to the attention of GCPS administration, they allowed the thief to return the welder and retire. Almost two years later we reported Larry Clark Lawson had been indicted by a Grand Jury and as part of a plea deal, had pled guilty to one of two counts of theft greater than $200.00. We have now uncovered some very disturbing facts about the theft and what actions GCPS took and didn’t take once it was reported to administration.

Mr. Lawson was the Foreman of the GCPS bus garage. Part of his duties included purchasing repair parts, tools, etc. related to maintaining GCPS’ fleet of vehicles. Mr. Lawson purchased a welder valued at over $2,000 using GCPS funds. He knew he had to have his supervisor’s permission to make such a purchase and did not tell her. He knew he could not purchase anything over $1,500 on the County credit card and talked the salesperson into breaking the cost into two separate purchases to hide what he was doing. He even talked the salesperson into submitting the two bills several days apart to make it harder to be discovered. One of the purchases was listed as being the welder and the other was for some sort of accessory kit that was not carried by or sold by the vendor; in fact, the accessory kit did not exist at all.

To further conceal his crimes, Mr. Lawson arranged for the welder to be delivered to the bus garage to his attention and during a period when he would likely be the only person there. Unfortunately for Mr. Lawson, the welder was delivered on Thursday, March 30, 2017 instead of during the following week when everyone would have been off for spring break. Because of this, numerous other employees saw the new welder when it was delivered and began to talk about it. Mr. Lawson had the delivery driver unload the welder in the “tire barn” which is typically used to store tires and old equipment. Later that day an employee of the garage noticed the welder had been covered with black trash bags. By the morning shift the next day the welder had disappeared from the “tire barn” and remained missing until April 19, 2017.

Mr. Lawson was finally confronted about the welder and several other items missing from the garage on April 19, 2017. Then Transportation Director, Anne Lanan; Human Resources Director, Gwyn Ciemniecki and Assistant Superintendent for Administrative Services, John Hutchinson were the confronters. When Mr. Lawson was first asked where the welder was, he said it was in the bus garage in the middle of the workstation; at that point the conversation ended, and Mr. Lawson was placed on administrative leave.

Ms. Lanan then went to the garage where she did not find the new welder. She informed Ms. Ciemniecki who then called Mr. Lawson and asked if there was anything else, he wanted to tell them. Mr. Lawson said he loaned the welder to Tabb Fox, a friend of his and owner of Fox’s Auto Repair. Ms. Ciemniecki told Mr. Lawson he needed to bring the welder back immediately and Mr. Lawson asked if he could have until 5:30 p.m. When he brought it back later that afternoon, he resigned from GCPS. No one ever saw the welder at Tabb Fox’s garage and its location was unknow for 19 days.

Well, all that sounds pretty cut and dry if you assume GCPS administration are the ones who contacted law enforcement. That is not what happened at all. They allowed Mr. Lawson to resign and walk away. If not for the due diligence of an anonymous source who reported the theft to the Sheriff, the Commonwealth’s Attorney and the State Police, Mr. Lawson would have been allowed to do just that, walk away. It must have been very disheartening for that anonymous citizen when they found out Mr. Lawson’s punishment was a conviction for only one of his crimes, no jail time, $500 in court costs and no way to verify Mr. Clemons or anyone else with GCPS submitted the required paperwork to revoke Mr. Lawsons Virginia Retirement System (VRS) benefits as required by Commonwealth law.

In late April the Sheriff, the anonymous source and the Commonwealth Attorney met, and it was decided to have the State Police investigate the anonymous source’s allegations. In a phone conversation after that meeting, the Sheriff informed Mr. Clemons of the complaint made by the anonymous source and let him know the State Police would be contacting him. Mr. Clemons “then” told the Sheriff about some returned stolen property and asked about filing a police report with the Sheriff’s Department. The Sheriff told him that based on a conflict of interest, he should notify the State Police instead. Imagine that, Mr. Clemons was ready to report returned stolen property after being told the State Police would be making contact. On May 17, 2017 a police investigator met with the Commonwealth Attorney to commence the State Police’s involvement.

Mr. Clemons and his administration appear to have closed the book on Mr. Lawson on April 19, 2017 when they let him resign and did not contact law enforcement; or so they thought until the anonymous source threw a wrench in their coverup. If you don’t believe it, ask Mr. Clemons to show the report filed with the Sheriff’s Department reflecting GCPS’ allegations of the theft. Ask him to show any report they filed with any law enforcement agency before the late April 2017 phone call from the Sheriff’s Department. He can’t because none exist. If Mr. Clemons and his staff intended to do the right thing, they would have called the Sheriff’s Department on April 19, 2017 when Mr. Lawson supposedly first lied to them about the welder’s whereabouts. At this point it is hard to trust anything coming from Mr. Clemons or the School Board.

Why were they covering for Mr. Lawson? What were the other items missing from the garage referenced in the Commonwealth’s Bill of Particulars? Why did it take 19 days after the welder went missing for GCPS Administration to confront Mr. Lawson? What other systemic accountability problems does GCPS have that have not yet come to light? Has Mr. Lawson’s VRS benefits been revoked through application by GCPS and in accordance with the Code of Virginia? Have corrective measures been taken to prevent this type of theft in the future? Are other areas within GCPS being looked at for signs of the same or similar weaknesses in accountability and control? Etc. etc. etc. We deserve answers to these questions and many more.

One thing is for certain out of what we know so far, Mr. Clemons is not the kind of public-school superintendent the citizens of Gloucester County need, want or deserve. If you do not align with his vision for GCPS, he has no use for you. He has lost accountability and control of the transportation division and who knows how many other areas within GCPS. He participated in covering up for a felon employee. He has created a work environment where employees are afraid to speak up, express an opinion or even speak about matters of concern during public comment at School Board meetings. It appears to be all about Mr. Clemons’ image and his vision for GCPS; whatever that truly is.

What do we do about it all? I and many others believe the best thing that could happen at this point, would be for Mr. Clemons and everyone, including School Board members, who participated in the coverup to submit their resignations from GCPS effective immediately. They have irreparably broken the citizens’ trust. Maybe they can all get a job working for the welder thief who seems to mean more to them than the students and taxpayers of Gloucester County and the Commonwealth of Virginia.

Virginia Attorney General; Private Law Firm For State Officials Only?

This was recently sent to us by one of our readers.  It shows something rather disturbing and it comes straight out of the Virginia Attorney General, Mark Herring's, office.  We are reprinting the message below.

Thank you for contacting the office of Attorney General Mark Herring.  We appreciate your taking the time to write to our office.

            The Office of the Attorney General functions as the law firm for state government and does not provide legal advice to private individuals.  The Office advises state officials and represents the various state agencies and departments, as well as renders opinions at the request of state officials.  Due to statutory restrictions, conflict of interest rules and other policy considerations, we are unable to render private legal advice or otherwise assist citizens in legal matters. 

            Having said this and after further review of your letter, I regret that this Office does not have the jurisdiction to assist in this matter.  I encourage you to reach out to the Virginia State Police for assistance with this investigation.

The name of the reader that this was addressed to has been removed.  Now this is where it gets interesting.  The reason for the contact had nothing to do with asking for legal advice.  It asked specifically for an investigation into interstate fraud.  Looking at the statement coming out of Mr Herring's office, it would seem that the statement made is that the Attorney General's office here in the state of Virginia is to serve only as the private law firm for state officials.  

Let's take a look back in time to about the year 1902.  We are going to quote straight from a text book that was written about the Virginia Constitution.

ATTORNEY-GENERAL.
 Elected. By the people for four years. Salary, $2,500 and mileage. Duties. Shall give his opinion and advice when required to do so by the Governor, or by any of the public boards and officers at the seat of government; shall appear as counsel for the State in all cases in which the commonwealth is interested, depending in the Supreme Court of Appeals, the Supreme Court of the United States, the District and Circuit Courts of the United States for the State of Virginia, and shall discharge such other duties as may be imposed by the General Assembly.

 Member of the State Board of Education. An attorney is a person who acts for and in the place of another. The word is usually applied to a lawyer who is employed by another to act for him in any law business he wishes to have done. An attorney who appears in a court of law and acts or defends a person, or acts against a person accused of crime, is called a counsel.

 The attorney-general is a lawyer who is elected to do law business for the State. He must appear in court as counsel for the State in every case in which the commonwealth (meaning the whole people) is interested. The commonwealth is interested in every case of crime, because it is for the interest or well-being of the people that those who commit crime should be punished. If this were not done— if criminals, persons who commit murder or burglary or theft—were not arrested and punished, no man's life or property would be safe. The attorney-general must appear and act for the commonwealth in any of the courts above mentioned whenever there is a case in any of them in which the people of the State are interested.

Now maybe this is why we have Commonwealth attorneys throughout the state.  But it does not answer why this office should not be looking into any issues of Interstate fraud.

Let's now look at what the online information says about the duties and responsibilities of the Virginia Attorney General.

Duties

The duties and powers of the office of the attorney general include:[1]
  • Provide legal advice and representation to the Governor and executive agencies, state boards and commissions, and institutions of higher education. The advice commonly includes help with personnel issues, contracts, purchasing, regulatory and real estate matters and the review of proposed legislation. The Office also represents those agencies in court.
  • Provide written legal advice in the form of official opinions to members of the General Assembly and government officials.
  • Defend criminal convictions on appeal, and defend the state when prisoners sue concerning their incarceration.
  • Defend the constitutionality of state laws when they are challenged in court.
  • Enforce state laws that protect businesses and consumers when there are violations. Individual consumer complaints are usually handled by another agency.
  • Represent consumers in utility matters before the State Corporation Commission.
  • Collect debts owed to state agencies, hospitals and universities.
  • Conduct or assist criminal investigations and prosecutions in certain limited cases (for example Medicaid fraud, money laundering, theft of state property, environmental crimes, and computer crimes).
  • Represent the Department of Social Services in its efforts to collect child support on behalf of children and families.
  • Supervise the appointment and payment of private attorneys hired by other state agencies for various matters.
  • Assist victims of crime who are following criminal cases at the appellate level.
  • Provide information to the public on Identity Theft prevention and remediation.
  • Administer grants to help reduce crimes involving gangs, drugs and sex predators.
  • Administer the Sexually Violent Predator Civil Commitment Program to protect children from the most dangerous predators.

But our present Virginia state Constitution says as follows;

Section 2. People the source of power.

That all power is vested in, and consequently derived from, the people, that magistrates are their trustees and servants, and at all times amenable to them.

The Virginia Attorney General is an elected official.  That means he is a servant of the people, not the private law firm for state officials only.  Yet as we move more to a total socialist nation, we are seeing that the term elected official no longer has any real meaning to it other than our rights no longer exist.  It's right there in the history before your eyes.  One could argue that society has become more complex and therefore the need to limit powers to this office is much needed.  It's an argument that does not stand.  More complex than what?  It's always been complex.  The bottom line is this, that answer that came out of Mark Herring's office is unacceptable.  At the very least, a contact person should have been setup for the person and the information passed on to the office recommended.  It was not.  Why?  Was his office trying to send the person who contacted them on some kind of wild goose chase and good luck, don't come back situation?  

  Did someone just decide they did not want to do something that resembled work?  Imagine.

Governor McAuliffe Kicks Off Unprecedented National Traffic-Safety Campaign

“Drive to Save Lives” initiative to safeguard Virginia’s highways during Summer tourism and travel season

Richmond, VA – Governor Terry McAuliffe today joined more than 100 state and local law enforcement, and traffic-safety advocates at the State Capitol to officially kick off the Memorial Day and summer traffic and tourism season. The morning’s press event is one of four being held statewide Tuesday to introduce the Commonwealth to Drive to Save Lives, the nation’s first-ever traffic-safety campaign of this magnitude. The nationwide initiative is two-fold: to reduce traffic deaths by 15 percent in 2014 across the country and within the Commonwealth; and to improve officer safety on our highways.

The Drive to Save Lives campaign is a united effort by state police and highway patrol leaders, police chiefs and sheriffs to reduce highway crashes and fatalities. More than 33,000 deaths occur each year on our nation’s roadways. Highway fatalities rank as one of the top 12 causes of death in the United States and it is the leading cause of death among teens.

“Virginia is proud to join this nationwide traffic-safety program as a way of making our highways as safe as possible,” said Governor McAuliffe. “The Commonwealth is averaging about 30 fewer traffic deaths this year in comparison to last year. But even one death is one too many, which is why the active participation of all motorists living, working and visiting Virginia is so invaluable to the campaign’s life-saving success.”

In 2013, Virginia reported 741 deaths resulting from traffic crashes. To achieve the campaign’s 15 percent reduction in traffic fatalities in 2014, there must be 111 fewer crashes and deaths on Virginia’s highways.

“Never before has the nation’s state police and highway patrol agencies teamed up for such a comprehensive enforcement initiative,” said Col. W. Steven Flaherty, Virginia State Police Superintendent. “The goal to save 111 lives on Virginia’s highways is an ambitious, but necessary one. We are simply asking the public to drive to save lives, not take them.”

In order to decrease highway fatalities in Virginia, state troopers, police officers and deputy sheriffs are leading a sustained effort over the course of the year that is data driven; focuses on the use of seat-belts and speeding; and targets impaired and distracted driving. The campaign also includes enforcement actions against the unsafe driving behaviors of the operators of large trucks and buses.

“Law enforcement officers across the Commonwealth work every day to change the high-risk behaviors of motorists that lead to crashes,” said City of Charlottesville Chief Tim Longo, current president of the Virginia Association of Chiefs of Police Board of Directors. “Hopefully uniting with our state and local counterparts through education and awareness, partnerships, and high-visibility traffic enforcement, we can have an even greater and positive impact on the motoring public.”

“Most traffic crashes, injuries, and deaths are preventable when drivers and passengers buckle up, drive the speed limit, don’t drive distracted, and never drink and drive," said City of Bristol, Va., Sheriff Jack Weisenburger, current president of the Virginia Sheriff’s Association Board of Directors. " This is a message we’ve heard time and time again, but is still worth repeating. Now we’re just asking drivers and passengers to put them into action.”

In Virginia, the law requires drivers to change to another travel lane or, when not able to, to cautiously pass vehicles equipped with blue, red or amber lights and stopped on the side of the road.The Virginia General Assembly this past session also passed Senate Joint Resolution No. 102, which designates June as “Move Over Awareness Month” in the Commonwealth (http://lis.virginia.gov/cgi-bin/legp604.exe?141+ful+SJ102ER).


“Reducing the number of traffic crashes isn’t the only reason for this nationwide campaign,” said Governor McAuliffe. “We also have a shared responsibility to help protect the lives of public safety professionals across the Commonwealth. Virginia’s local and state law enforcement will be doing their job to make your summer travels as safe as possible. In return, do yours. Move over for them. Drive to save lives. Let’s finish 2014 with fewer crashes, fewer public safety professionals injured or killed on the job, and hopefully, 111 lives saved in Virginia.”

Gloucester, VA Public Servants or Public Greed Gratification? The Test

What was the motivation for you to go into public service?

The Virginia Constitution was written for us to limit the government intrusion into our lives.  Have you ever read the Constitution of the United States?  How about the Constitution of Virginia?

“All officers elected or appointed under or pursuant to this Constitution shall, before they enter on the performance of their public duties, severally take and subscribe the following oath or affirmation:
‘I do solemnly swear (or affirm) that I will support the Constitution of the United States, and the Constitution of the Commonwealth of Virginia, and that I will faithfully and impartially discharge all the duties incumbent upon me as ________________, according to the best of my ability (so help me God).’"

To all of our elected county officials what was your motivation?  Was it for the public good or for personal gain?  Were you looking to game the system to get special treatment to help your business or possible personal gain?  Maybe you want your child to get special treatment in school?  Maybe you want special treatment for permits or inspections?  We can watch your actions and see who is in there for personal gain.  Maybe you want to serve the public and make everyone’s lives a little better?  We can watch your actions and see who is there for the public good also.

What is a public servant an elected or hired person that works for local, state, or federal government.  Servants by definition do not get rich performing their duties.

A person going into public service is there to serve the public.  If your motivation is to get rich go into private service.  There are two main reasons to go into public service: to serve the public and to avoid risk. Neither reason is bad.  Looking for a safe job, minimum layoffs, benefits that take care of your family’s basic needs and the ability to contribute to the good of society?  If you want to get rich you need to go into private service working for yourself or a company that will pay you for what you are worth to them.  Think of public service like a bank account – you will never get rich off of the interest that is paid but you can keep you head above water.  Private Service is like the stock market – you can get rich you also can get poor there are no guarantees.

During the budget process 100 people got up and said they wanted more money.  It is time for you to get out of public service and go into private service.  The public service will be much better without you.  How much of the general public supported your request for raises?  I think all 6 people not associated with the schools said no to raises your services do not justify raises during these tough economic times.

Our Notes:  It's not hard to create a test to show which ones pass the public servants designation and which ones pass the personal greed and gain designation test.  But maybe with a little magic, Ted can wave his left hand and it might all go away.   You can always dream now can't you?

Governor McAuliffe Statement on Lynchburg Train Derailment

Governor Terry McAuliffe released the following statement on the Commonwealth of Virginia’s response to the train derailment and fire in Lynchburg, Virginia:

“This afternoon my Public Safety team informed me of the train derailment and fire in Lynchburg. Immediately after those reports were received the Virginia Department of Emergency Management, the Virginia State Police, and the Virginia Department of Fire Programs were instructed to coordinate with local responders and mobilize the resources necessary to respond to this incident.

“Deputy Secretary of Public Safety and Homeland Security Adam Thiel has been dispatched to the scene and will provide my team and me with constant updates as this situation unfolds. I have also spoken with Lynchburg Mayor Michael Gillette and offered him any and all resources he needs to respond to this incident and keep Virginians safe.”

Mapping Gloucester, Virginia's Future? The Heart of Gloucester County



The above picture is what we have been able to put together based on over a year of watching the Gloucester Board of Supervisors meetings, watching the actions of the Gloucester School board, and looking into what the golden triangle has been planning and promoting as well as viewing the plans of a few local developers.  We like to call this the new Heart of Gloucester.  It's what it looks like when you draw out the plans of what is both seen and not seen.  It looks like a heart.

  What is within that heart;  The up river crossing.  606 across the river to York County to meet up with route 199.  A gateway to Williamsburg and a much faster route to I64.  Plus on the other side is a new road that would need to be constructed to alleviate the traffic congestion along business route 17 moving onto route 14 in the courthouse area.  A road that may go through some very interesting properties and who holds some of those properties.

  Questions that we will be raising over the coming months, has a newly created landmark been put in place to maintain traffic congestion?  What is the future of that landmark if that is the case?  Is mixed use development in the plans of those who are behind secret plans?  Has inside information been used for insider trading?  Have property deals been made to enrich the few privy to secret information and how did they get to those secrets?

  What place does the golden triangle play in all of this?  Who are those in the golden triangle?  How can you profit from this information?  Beware letting certain property sell cheap.  It may just be worth much more than you think.  Are certain people being considered for judge positions based on their willingness to further certain plans now in place even if it means not following the law?  Some odd questions, we know.  But we have seen some odd facts that brought us to this point and are causing us to ask these questions.

  Is a certain popular teenager's park going to go away on route 14 to make way for a new road?  Did the tear down of remains and a move to a new location of Page Middle school play a place in all of this?  We can not answer a lot of these questions.  But we are going to be showing you the facts and information that has led us to ask all of these questions and many more.  We think that if secret information is being used to enrich the few whom are privy to such, then everyone should have equal access to that same information and have the same privileges to make money on these deals as well wherever possible.  Plus it sheds a light on those who are behind those deals and makes those deals much harder to profit from and lets everyone know the kind of people they are dealing with.

  We will leave you to come to your own conclusions as we go through all of the information we have been collecting as well as information already shared along with all of the new information we will be bringing you.  It's been a very long and tedious process and the culmination and joint efforts of many to bring you what we will be sharing.  So stay tuned.  We promise that it's going to get very interesting.
