Cuccinelli asks Kaine and Warner to delay acting on labor board nominees until Supreme Court decides constitutionality of Obama recess appointments 


RICHMOND (July 19, 2013) - Last night, Attorney General Ken Cuccinelli sent a letter to Virginia senators Mark Warner and Tim Kaine requesting that they delay acting on President Obama's recent nominations to the National Labor Relations Board until the U.S. Supreme Court decides the constitutionality of the president's previous appointments to the board. Obama made his previous appointments without the constitutionally required Senate confirmation by claiming that the U.S. Senate was in recess when it was not.

Recess appointments are emergency appointments the president makes to commissions and boards when the Senate is not in session and he determines that he cannot wait for the Senate to reconvene to hold hearings to confirm his nominees. However, only the Senate can declare itself in recess, not the president. The president made three appointments to the NLRB when the Senate was merely not meeting for three days but had never recessed.
Three federal appeals courts, including the Fourth Circuit, have declared the original appointments unconstitutional. The D.C. Circuit Court case has made it to the Supreme Court.

If the Senate moves forward with approving the president's new nominees, Cuccinelli says actions by the new board could render the issue moot and the Supreme Court would not be able to decide this important separation of powers issue, which would clarify the issue for future appointments.

Governor Bob McDonnell Not Responsible For Protection of Virginia Citizenry?

We recently sent complaints to Governor Bob McDonnell, Virginia State attorney general Ken Cuccinelli, and local Delegate Kieth Hodges about Gloucester County's failure to comply with it's own approved ordinances.  Specifically, 3-15 of the Gloucester Animal Control laws.  The heading on the law as it presently stands is in violation to what the Gloucester County Board of Supervisors voted on and approved for how it should read.

At present, the code reads as follows;  " Failure to perform duties of ownership; penalty.".  The Board of Supervisors voted on and approved the following as the proper header for that code, "Care of companion animals. penalty".    Gloucester County officials refuse to comply with their own laws.

Here is the response we just received from Governor Bob McDonnell's office.


Thank you for contacting the Office of Governor Robert F. McDonnell.  Governor McDonnell is in receipt of your letter and he has asked me to respond on his behalf.

By your letter, it is clear that this matter is of the utmost importance to you.  However, it has been determined that your issue is a local matter in which Governor McDonnell does not have the authority to intervene.  It is recommended that you contact your local representative on either the Board of Supervisors or the City Council.  If you live in a city, you may also wish to contact the Office of the Mayor.  I am confident that a local representative will be able to appropriately address your concerns.

Thank you again for contacting the Office of the Governor.  Please do not hesitate to do so regarding future matters.

Your kidding right?  You can not respond to the email they sent.  It's blocked.  It's the local Gloucester County Board of supervisors that are not in compliance.  They have been notified and have refused to address the issue.

Now someone please correct us if we are wrong, but isn't it the state's duty to protect the citizens of each state? This is what we call passing the buck and is nothing more than a bureaucratic trick.  

Now we really can not blame the governor for this answer as he did not answer it.  An aid did and with the wrong answer at that.  It shows she did not read the complaint.  THE BOARD OF SUPERVISOR'S ARE THE ISSUE!

Monsanto's GMO Foods Killing People?

If you’ve been primarily a reader of the mainstream press, you’ve probably been misled into thinking genetically engineered (GE) crops are the greatest thing since sliced bread, that they provide better yields of equal or better quality food, pest and weed resistance, reduced reliance on pesticides, and more... But thankfully, the truth is unfolding and the tide is finally beginning to turn.
I have long warned against GE crops, pointing out the risks associated with their consumption, and the falsehoods presented about their safety. Now, the mainstream press is finally joining in.
The Fox News report above does a remarkably good job of questioning the logic behind, if not safety of, GE foods and genetically modified organisms (GMOs)—from crops with built-in pesticides, to salmon designed to grow abnormally large and fast.
I’m very pleased that Fox News pointed out the fact that potential health hazards cannot be averted simply by avoiding the GE crop in question. Animals raised on GE-grain feed will in turn produce GMO-tainted meat, milk, and eggs, for example, thereby affecting the vast majority of the food supply.
Fox News even reported the disturbing findings from feeding studies showing intestinal damage in animals fed Bt corn, and the potential links to food allergies, antibiotic exposure, and increased exposure to pesticides.

Let’s Get GMO’s Labeled!

Even though Prop 37 in California last November just missed passing, it generated enormous amounts of exposure on this issue, far more than what was spent on the campaign. That exposure will be the catalyst to our eventual victory.
In the past few weeks, Connecticut and Maine have passed GMO-labeling bills, and 20 other states have pending legislation to label genetically engineered foods. So, now is the time to put the pedal to the metal and get labeling across the country—something 64 other countries already have.

Is Monsanto Losing the Press?

Statistics showing skyrocketing increases in pesticide use due to resistance is just one problem that demonstrates the abject failure of GE crops. In a recentMother Jones article2, Tom Philpott lists some mainstream reporters that have come down hard on Monsanto and their biotech allies in recent weeks, most of them highlighting the growing pest and weed resistance these crops have produced.
For example, NPR’s agriculture reporter Dan Charles recently reported3 on the high increase in pesticide use following the failure of Monsanto’s Bt corn, engineered to contain the bug-killing gene of the bacteria Bacillus thuringiensis—which essentially turns the corn plant into a pesticide itself. Ian Berry writing for the Wall Street Journal4 has also reported on the “comeback” of pesticides, as “Mother Nature outwits genetically modified seeds.”
The following graph, from the Food and Water Watch dramatic report titled: Superweeds: How Biotech Crops Bolster the Pesticide Industry5, published earlier this month, illustrates the dramatic increase of pesticide use as resistance began taking hold in the early 2000’s. According to their report, use of 2,4-Dichlorophenoxyacetic acid (2,4-D), a broadleaf herbicide and the active ingredient in the infamous Agent Orange (another Monsanto disaster), has also more than doubled since 20026.
 

There are other signs of progress as well. The restaurant chain Chipotle, for example, now lists GE ingredients used in their meals on their web site. This victory was achieved by the blogger and food activist Vani Hari, who has investigated the products sold by a number of major restaurants and food companies, including Chipotle, Starbucks, Subway and Kraft.
Whole Foods has also promised to label GMOs sold in their stores within the next five years. This long lead time is required primarily because of their meat products, which is an enormously long and complex chain to certify. Despite the five-year deadline, this announcement is incredibly encouraging and represents a major sign that all the efforts most of you put into the California Proposition 37 campaign have paid off. We may have lost that battle but this, and other, signs strongly suggest we arewinning the war.
Then there’s the GE wheat debacle, which has raised questions about accountability and sparked alarm among Washington traders. When the blame started shifting too heavily onto Monsanto (where it rightly belongs), the company concocted one of the weirdest conspiracy theories out there7. The company basically wants you to believe that some anti-GMO saboteur collected and saved GE wheat seeds from their test plots a decade ago, and then sprinkled them in an Oregon wheat field as an act of sabotage... Yeah, right.

Pest and Weed Resistance Is Flourishing

After years of assurance that genetically engineered crops are the answer to pesky pest problems, corn rootworm is now turning into a nightmare for farmers and biotech companies alike, as the insects are developing resistance to the Bt gene in the crop that is designed to kill them. It didn’t take all that long for the bugs to develop their defenses and render the genetic manipulation useless either—only about 10 years from the introduction of Bt crops.
This is particularly tragic as very simple measures like the incorporation of biochar and the regular application of compost teas are far superior to GMO technology and also increase the soil vitality, rather than decimate it like GM crops do.
Last year, 22 of America’s top experts on corn pests urged the U.S. Environmental Protection Agency (EPA) to take action "with a sense of some urgency8.” They also urged seed companies to stop routinely inserting anti-rootworm genes into their corn lines to prevent devastating losses. The economic impact could be huge. Billions of dollars are at stake as Bt-stacked corn varieties account for 71 percent of all corn grown in the US9 as of 2013—up nearly 20 percent from 2012.
“It appears that farmers have gotten part of the message: Biotechnology alone will not solve their rootworm problems,”DanCharles writes. “But instead of shifting away from those corn hybrids, or from corn altogether, many are doubling down on insect-fighting technology, deploying more chemical pesticides than before.
Companies like Syngenta or AMVAC Chemical that sell soil insecticides for use in corn fields are reporting huge increases in sales: 50 or even 100 percent over the past two years... As a result, [the farmers] may just keep growing corn, fighting rootworms with insecticides — and there's a possibility that those chemicals will eventually stop working, too.” [Emphasis mine]

Gloucester New Potato's In Cream - Recipe of the day



4 new potatoes
1 qt. water
1 t-salt


Scrape four medium sized new potatoes. Cook in boiling water (salted) until tender when pierced with a fork. Drain off the water, and shake the kettle over the fire gently, to allow the steam to escape and make the potatoes mealy. Make the following white sauce and pour over the potatoes.

White Sauce for New Potatoes (Two portions)
2 T-butter
2 T-flour
1 C-milk
½ t-salt
¼ t-paprika


Melt the butter, add the flour, salt and paprika. Thoroughly mix, slowly add milk, stirring constantly. Allow sauce to cook two minutes.

Make something extraordinary tonight.

Gloucester Board of Supervisors Still Out of Compliance.



We just checked the Gloucester Animal Control ordinances site again and noted that it is still out of compliance with what the Board of Supervisors voted and approved it to be.  We are talking about ordinance 3-15, the title is way out of compliance.  It's become typical not to trust county officials to do their jobs properly.  The above video is more of an audio file.  It's an actual 911 audio recording that was presented in a Gloucester Animal Control court case.


 There are so many things wrong with the above audio it is not even funny.  Holli Cahoon, owner of the local Sunrise Donuts on route 17 south, George Washington Mem Hwy, was the 911 operator at that time.  She couldn't even keep her testimony on this audio straight.

  We had the above audio checked out by  a professional 911 operator in another area.  She told us so many areas where the audio was in violation of prescribed procedures for 911 incoming calls that the list is just to large to go over in this post.

  Listen to it several times, how many issues can you pick up?  We have a large number of files like this on the county.  It does not surprise us that they have no regard for actual laws and seem instead to just make them up as they go along.  Their sworn oaths meaning nothing.  

The youtube video was previously hidden on the site, we have now made it public along with a number of other issues we have found with Gloucester County  audio files.  The public has a right to know.

Captain Molly - The Fierce and Beloved Woman of the American Revolution



Liberty's Kids episode number 19.  Captain Molly.  We did some digging to find the real story about Captain Molly.  Again, you can see how well researched these episodes are.  Finding the matching content can be a real challenge but we believe we have found the rest of what we need to continue to keep up.

Gloucester Officials Violating Oath of Office? Legal Repercussions

The staff here had some great ideas and so went to work on looking up state laws regarding the oath of office each official must take before they are allowed to serve.  Here is what they have come up with so far.

49-1. Form of general oath required of officers.

Every person before entering upon the discharge of any function as an
officer of this Commonwealth shall take and subscribe the following oath: "I
do solemnly swear (or affirm) that I will support the Constitution of the
United States, and the Constitution of the Commonwealth of Virginia, and that
I will faithfully and impartially discharge all the duties incumbent upon me
as .......... according to the best of my ability, (so help me God)."



§ 24.2-120. Oath of office.

The oath of office for the members of the electoral board, registrars, and officers of election shall be the oath stated in Article II, Section 7, of the Constitution. Each member of the electoral board, registrar, and officer of election shall take and sign the oath before performing the duties of his office.

Each member of an electoral board and general registrar shall file the original signed oath in the clerk's office of the circuit court of his county or city. The general registrar shall file a copy with the secretary of his electoral board.

The oath of office for assistant and substitute registrars, officers of election, and voting equipment custodians may be administered by a general registrar or a notary as well as by persons authorized to administer oaths under § 49-3.

The oath of office for officers of election may be administered by a member of the electoral board, the general registrar, an assistant or substitute registrar, as well as by notaries and persons authorized to administer oaths under §49-3.



Article 2

Section 7. Oath or affirmation.

All officers elected or appointed under or pursuant to this Constitution shall, before they enter on the performance of their public duties, severally take and subscribe the following oath or affirmation:

"I do solemnly swear (or affirm) that I will support the Constitution of the United States, and the Constitution of the Commonwealth of Virginia, and that I will faithfully and impartially discharge all the duties incumbent upon me as ...................., according to the best of my ability (so help me God)."

Section 8. Electoral boards; registrars and officers of election.

There shall be in each county and city an electoral board composed of three members, selected as provided by law. In the appointment of the electoral boards, representation, as far as practicable, shall be given to each of the two political parties which, at the general election next preceding their appointment, cast the highest and the next highest number of votes. The present members of such boards shall continue in office until the expiration of their respective terms; thereafter their successors shall be appointed for the term of three years. Any vacancy occurring in any board shall be filled by the same authority for the unexpired term.

Each electoral board shall appoint the officers of election and general registrar for its county or city. In appointing such officers of election, representation, as far as practicable, shall be given to each of the two political parties which, at the general election next preceding their appointment, cast the highest and next highest number of votes.

No person, nor the deputy of any person, who is employed by or holds any office or post of profit or emolument, or who holds any elective office of profit or trust, under the governments of the United States, the Commonwealth, or any county, city, or town, shall be appointed a member of the electoral board or general registrar. No person, nor the deputy or the employee of any person, who holds any elective office of profit or trust under the government of the United States, the Commonwealth, or any county, city, or town of the Commonwealth shall be appointed an assistant registrar or officer of election.

The amendment ratified November 4, 1986 and effective January 1, 1987—In paragraph two, after "officers", deleted the words "and registrars" and added "and general registrar" after "of election". In paragraph three, after "the electoral board or", added the word "general" before "registrar" and deleted a reference to officer of election, and added the last sentence: "No person, nor the deputy or the employee of any person . . .".

Now the questions arise, after oath of office by officials, officials who violate said oath, are they personally liable for damages they cause?  No longer protected by government matters as they were found outside of of their office in their actions?  

How does this apply?  Recently we reported and showed conclusively that the Board of Supervisors of Gloucester County voted on and passed new ordinances for Animal Control back in February of this year, 2013.  We have further shown that the county has not implemented these approved changes in full.  Both Twitching Ted (I'm not an attorney) Wilmot, so called county attorney have a legal obligation to ensure that the changes were correctly made, Brenda Garton, county administrator equally had a duty and responsibility to ensure the changes approved were properly implemented.  Both have failed in these duties.
With the Board of Supervisors having taken oath of office, each member of the Board had an equal responsibility to ensure that the voted on and approved changes were properly implemented.  All 7 failed in that duty.  We have shown to all 7 Board of Supervisors as well as the county administrator, Brenda Garton, where they are in violation of their own approved ordinances and still the violation is left standing.
So the question we are looking at is are all of these people in violation of the oath of office?  If so, are each person personally liable for any abuses in law that this violation may have caused?  Or in plain simple language, can each of these individuals be sued and not have any government protection because they acted outside of their own offices?  
Let's look at a fictitious, but possible example.  If Animal Control has prosecuted anyone after February, 2013 under Animal Control ordinance section 3-15, anyone prosecuted under this ordinance since it is in violation of state law as it is in violation of what the Gloucester County Board of Supervisors did approve for what that ordinance must state word for word, then those who were prosecuted could claim malicious intent and sue each person on the Board of Supervisors, the county administrator and Twitching Ted, (I'm not an attorney) Wilmot, all outside of government protection for each of these individuals because the ordinance was not properly executed according to the counties own orders?
It's looking to us like the Oath of office is a valid issue and a serious problem for each of these individuals.  In even simpler language, an individual prosecuted under 3-15, Gloucester County Animal Control ordinance, has 9 people to potentially sue and those 9 people are not covered by government protection.

Now we are not attorney's and this is not meant as legal advice.  This is simply research we are conducting.  We are digging deeper into this matter and looking at case law as we believe we have found the underbelly of the beast.  As of Tuesday morning, July 23rd, 2013, the Gloucester County Animal Control laws section of the website has not been brought into compliance.

God help them if they are found in violation of the oath's of their offices.

On further notes, one has to ask, are the county officials anarchists?  They do not follow the law from what we see.  Why should anyone else?  No one should be prosecuted in Gloucester, Virginia for any reason when our own leaders can not follow the laws.
